Interest Rate Not Ascertainable Sample Clauses

The 'Interest Rate Not Ascertainable' clause defines what happens if the agreed-upon interest rate for a loan or financial agreement cannot be determined using the specified method or reference rate. In practice, this clause typically outlines alternative procedures, such as appointing a new reference rate, using a fallback rate, or allowing the parties to negotiate a replacement rate. Its core function is to ensure continuity and certainty in the agreement by providing a clear process for determining the interest rate, thereby preventing disputes or delays if the original rate becomes unavailable or unworkable.
