INVESTMENT CORPORATION. The Corporation is not, and is not an Affiliate of, and immediately after receipt of payment for the Shares, will not be or be an Affiliate of, an “investment company” within the meaning of the Investment Corporation Act of 1940, as amended. The Corporation shall conduct its business in a manner so that it will not become subject to such act.
INVESTMENT CORPORATION. EPOD is not, and is not an affiliate of and, immediately after receipt of payment for the Purchase Securities will not be or be an affiliate of, an “investment company” within the meaning of the Investment Company Act of 1940, as amended.
