JOB VACANCIES AND PROMOTIONS. 27.1 A notice of all positions, which are declared vacant, will be sent via email to sites and departments, shall be posted in each school, work site, and at the District’s Human Resources office for no less than five (5) working days. A copy of such notice shall be sent to the Association at the time of posting. Job postings shall also be accessible via the District website/Human Resources Department.
27.2 The job vacancy notice shall contain the job title, a brief description of the position and duties, the minimum qualification, location, salary, and other pertinent information.
27.3 Bargaining unit members on leave or holding positions of less than twelve (12) months may request notification by the Human Resources Development office when vacancies occur during periods they are not on duty.
27.4 All bargaining unit members who apply and meet the announced position specifications shall be interviewed and considered for the position. Specifications shall include a level of “meets requirements” on the bargaining unit member’s most recent evaluation within the previous two years. Upon request, any bargaining unit member who was not interviewed shall be provided with the reason for not being granted an interview.
27.5 Bargaining unit members who are interviewed shall be notified regarding the disposition of their applications for the stated positions. Issues arising out of the exercise of the District’s discretion in making employee requested transfers, District initiated transfers, or in the bargaining unit member’s application selection process, including the facts underlying the District’s exercise of such discretion shall not be subject to the grievance procedure.
27.6 Promoted bargaining unit members shall retain permanency within the District and shall retain seniority rights to the vacated position classification. Promoted bargaining unit members shall have six months’ probation in the new position. The bargaining unit member or manager may initiate a return to the position classification vacated at promotion at any time during the six-month probationary period. However, by mutual agreement between the bargaining unit member and the District, the bargaining unit member may move to another vacant position within a classification of equal or greater pay than the position vacated when the bargaining unit member was promoted.
JOB VACANCIES AND PROMOTIONS a. Vacant bargaining unit positions or newly created bargaining unit jobs will be posted for eighteen (18) days in order that existing Employees may apply.
b. Copies of all postings will be posted in a lockable bulletin board in the main shop building, warehouse lunchroom, and Townsite and an electronic copy will also be sent to the Union.
c. Employees wishing to apply must do so in writing by submitting the application to Human Resources or the application box.
d. No applications from Employees received later than the posting closing date will be considered.
e. Employees who are on vacation or going on vacation or approved leave may submit an intention to bid notice to Human Resources, outlining the jobs they would wish to bid on in their absence. This bid will be valid until the end of their vacation or approved leave.
f. The Company will endeavor to award the successful applicant and notify the Union within five (5) business days from the date the posting closes. Successful candidates will be notified by email or phone (voice message) if provided on the application. The Company will endeavor to re-assign the successful employee within 336 hours.
g. The job posting shall include:

JOB VACANCIES AND PROMOTIONS. Whenever job vacancies in the bargaining unit occur, the University agrees to provide an electronic copy of the vacancies to the current president of the union. The University will provide a brief description of the duties of the position, the salary range, and minimum requirements and qualifications of the position. Employees who wish to be considered for the bargaining unit vacancies must follow the directions for applying for the position in the job posting and submit required documentation to the Office of Human Resources prior to the closing date. If an employee is not interviewed or selected for a position that person has applied for, the employee may contact the Office of Human Resources to obtain a written explanation of why the employee was not selected for that position.

Whenever the City determines that a non-promotional vacancy exists which the City elects to fill, the City shall post a notice of the opening or openings for five (5) consecutive working days City-wide. Whenever the City determines that a promotional vacancy exists which the City elects to fill, the City shall post a notice of the opening or openings for five (5) consecutive working days in the department where the vacancy occurs and City-wide. The notice shall contain the job classification, title, rate of pay, department, shift, area of vacancy, brief job description, qualifications and date of posting.
Section 2. Employees who wish to be considered for the posted position must file a written application with the Department Head by the end of the posting period.
Section 3. These applications will be reviewed by the Department Head and the City Manager, and the job shall be awarded within ten (10) working days of the close of bids if filled internally; employees awarded the job will be physically transferred to the new job within thirty (30) days of the award. Jobs will be awarded in accordance with the following:
A. Evaluation of qualified applicants shall first be from the Department where the vacancy occurs, and then from the bargaining unit.
B. The Employer will evaluate the job applicants in the following categories to determine if the applicants meet the job qualifications: knowledge, skills, and abilities; past work record; and seniority. This may include an interview process to determine qualifications. The employee may be required by the Employer to perform a practical demonstration of his skills, abilities, and qualifications. The Employer, at its sole and exclusive discretion, may select the employee that it determines to be the most qualified after taking into consideration the relative skills and abilities of all bidders with respect to the requirements of the open position. Whenever two (2) or more employees bid on a job and the Employer determines that the employees are equally qualified, the City shall award the job to the employee with the greatest seniority. In the event that the Employer determines that no internal candidates are qualified or suitable for the position, it may elect to expand its process to include external candidates. In the event an employee is not selected, the Employer will provide written feedback to the employee if requested.

(a) The BOARD agrees that in the event that any vacancy occurs, as it relates to positions within the bargaining unit, including administrative and extra-curricular positions during the period covered by this Agreement, including positions for the subsequent school year, such vacancy shall be posted immediately upon the BOARD’s having actual knowledge, and prior to any other public disclosure of the same by the BOARD, other than to announce a resignation.
(b) It is the understanding, between the parties hereto, that all reasonable efforts will be made to communicate such vacancies to the personnel covered under this agreement, during the summer period, in a reasonably timely manner.
2. Such notices shall describe such vacancy positions together with the procedure necessary for members of the bargaining unit to make application for said vacancy.
3. It is the intention of this Article that all such vacancies be announced to present personnel within the district prior to being offered to others. It is the intention of this Article, that all persons covered hereunder shall have the opportunity to apply for all such vacancies prior to their being offered to others and then to be considered for such vacancies. The aforementioned positions shall not be filled until seven (7) days after the posting of the notice referred to above.
4. The BOARD reserves the right to select the candidate for all positions in the school system, which selection shall not be subject to any review.

11.02 When filling vacancies or promotions, provided the applicants have the qualifications and ability to perform the required work, seniority will be the determining factor. In the event that there are no applicants or that none of the applicants for the position has sufficient qualification and ability to properly perform the work in question, the Company reserves the right to fill the position from any source.
a) An employee accepting a new position shall be allowed to revert to his former position (crew and start time) during the first three (3) shift cycles of his new position for any reason. If, during this same period, it appears to the Management that such employee does not have the ability to perform the duties of the new position, the Company may, after consultation with the Union, require him to revert to his former position. During this same period an employee shall not be disciplined or discharged for failure to meet requirements of his new position (gross negligence excluded). If an employee returns to their former position, they will not be eligible to apply for another job posting for a period of 6 months if it is their second time reverting back within twelve (12) month period unless mutually agreeable to the Company and the Union.
b) The selected applicant will not be eligible to apply for a further job posting for a period of six (6) months from the end of the 3 cycle trial period (per 11.03 a)) unless he specifically so requests and it is mutually agreed between the Company and the Union or if there is any significant change in job tasks (i.e. shift, start – stop times, work scope).

B. Employees desiring consideration for such positions shall submit a request, via the districts electronic application portal.
C. All things being equal, promotions shall be awarded to the employees according to date of hire.
D. The successful bidder shall receive a probationary period of sixty (60) days on his new assignment. Such employee shall be compensated at the rate of pay of his or her new classification.
E. The employee shall be kept advised of the progress or lack of progress made in learning the new assignment. If the employee fails to successfully meet these requirements within the probationary period, he or she shall be returned to his or her former classification and shall assume seniority in pay as though he or she had never left his or her former classification.
F. A dispute arising over the application of this Article shall be subject to the grievance and arbitration procedure.
JOB VACANCIES AND PROMOTIONS. When a new position of responsibility is created by the Board, the salary and additional allowance for such a position shall be arrived at through negotiations with the authorized representatives of the Teachers' Federation before the new position is advertised or an appointment is made. Subject to any legislation as a result of the extension of full funding, Teachers employed by the Board shall be given priority when applying for new or vacant positions.
