Jury/Subpoena Leave. Any bargaining unit member who is summoned for jury duty or who is subpoenaed before a Court, agency or private party as a witness, so long as the bargaining unit member is not appearing as a witness or party adverse to the Board, shall be entitled to special leave for such duties, without charge upon his/her sick or personal leave. Such employee further shall be entitled to his/her regular pay, less any fees or compensation received by such employee from the Court, agency or private party.

Jury/Subpoena Leave. Any Employee who serves on a court jury or appears in response to a subpoena as a witness in a court trial, or to have a deposition taken in any school related matter when he/she otherwise would have been scheduled to work, shall be paid for the regular straight-time hours he/she would have worked. An Employee who serves as a witness in a court proceeding or appears in court for a non-school related matter because the Employee is party to a lawsuit will not be paid for his/her absence.

  • Subpoena Leave 4.11.1 When a unit member is absent because of a mandatory court appearance, except as a litigant, the unit member shall suffer no monetary or sick leave loss by reason of this service. 4.11.2 Fees, exclusive of mileage, paid by the court or party requiring a unit member's appearance shall be paid to the District unless the fees are greater than the unit member's salary, in which case the unit member may retain the fees and be listed as absent due to personal business without pay. 4.11.3 A copy of the subpoena or certificate of the clerk of the court must be filed with the absence report.

  • Jury Leave In keeping with the policy that an employee not suffer a loss of pay while serving as a juror, the remuneration to be received by the employee on any working day the employee reports for or serves on jury duty shall be regular rate of pay for the day less jury duty fees receivable for that day.

  • Jury and Witness Duty Leave 23.01 Employees who have been summoned to be a juror or witness by any body in Canada with the power to subpoena shall supply their supervisor with a copy of the summons as soon as possible after receipt of same. 23.02 Employees who have complied with Article 23.01 shall be given leave of absence without loss of normal salary during such service, provided that upon return to work they shall supply their supervisor with written confirmation of the dates on which they served, signed by an official of the Court or by the counsel for the party who required their attendance.

  • Volunteer Leave Subject to operational requirements as determined by the Employer and with an advance notice of at least five (5) working days, the employee shall be granted, in each fiscal year, a single period of up to seven decimal five (7.5) hours’ of leave with pay to work as a volunteer for a charitable or community organization or activity, other than for activities related to the Government of Canada Workplace Charitable Campaign. The leave will be scheduled at a time convenient both to the employee and the Employer. Nevertheless, the Employer shall make every reasonable effort to grant the leave at such a time as the employee may request.

  • Study Leave Credits for study leave will be given for educational commitments falling due between an employee's nominated starting and finishing times.

  • Jury and Witness Leave An employee will be granted paid leave for time spent responding to a summons for jury duty, time spent participating in the jury selection process, time spent actually serving on jury, or when subpoenaed to appear in court. An employee will not be terminated, disciplined, threatened or otherwise subjected to adverse action because of the employee’s receipt of or response to a jury summons. The employee shall present documentation of his or her jury service to the building principal or an immediate supervisor. If the subpoena is directly related to the employee’s school duties, the employee will be released for court appearance without loss of leave. Other court appearances due to personal situations will be deducted from the employee’s personal business leave.

  • Parenting Leave Parenting Leave consists of Maternity Leave and Parental Leave. Parental Leave includes Paternity and Adoption Leave.

  • FMLA Leave The Board agrees to comply with the Family and Medical Leave Act and agrees that any policy adopted to implement the FMLA shall in no way reduce or adversely impact any other provision of this Agreement.
