Common use of Late Filings Clause in Contracts

Late Filings. To the extent any information required to be delivered pursuant subsection (a) or (b) above is not delivered within the time periods specified therein and such information is subsequently filed or furnished, as applicable, on the SEC’s XXXXX system (or any successor system adopted by the SEC), the Issuer will be deemed to have satisfied its obligations with respect thereto at such time and any Default or Event of Default with respect thereto shall be deemed to have been cured unless the Securities have previously been accelerated in accordance with Section 6.02.

To the extent any information required to be delivered pursuant subsection (ato Section 4.02(a) or (bSection 4.02(b) above is not delivered within the time periods specified therein and such information is subsequently filed or furnished, as applicable, on the SEC’s XXXXX system (or any successor system adopted by the SEC), the Issuer will be deemed to have satisfied its obligations with respect thereto at such time and any Default or Event of Default with respect thereto shall be deemed to have been cured cured, unless the Securities have previously been accelerated in accordance with Section 6.02.
