Common use of Later Joinder by States Clause in Contracts

Later Joinder by States. After the Preliminary Agreement Date, an Eligible State may only become a Settling State with the consent of Allergan, in its sole discretion. If a State becomes a Settling State more than thirty (30) days after the Preliminary Agreement Date, the Subdivisions and Special Districts in that State that become Participating Subdivisions and Participating Special Districts within ninety (90) days of the State becoming a Settling State shall be considered Initial Participating Subdivisions or Initial Participating Special Districts.
