Leasing and possession. (a) The Assignor will not lease, let out, or grant any licence or otherwise in any manner part with the possession or make or accept the surrender of any lease of or in respect of the Property or any part of the Property to any person, firms, or companies without the prior written consent of the Bank.
(b) The Bank‟s consent may be given or refused at the Bank‟s absolute discretion, and the decision of the Bank will be final and conclusive.
(c) The Assignor assigns and covenants to assign absolutely to the Bank all the present and future rent, licence fees, rights and benefits accruing to the Assignor under any lease, tenancy, grant or licence in respect of the Property.

(a) The Chargor will not lease/sub-lease, let out, or grant any licence or otherwise in any manner part with the possession or make or accept the surrender of the Lease in respect of the Land or any part of the Land to any person, firms, or companies without the prior written consent of the Chargee.
(b) The Chargee’s consent may be given or refused at the Chargee’s absolute discretion, and the decision of the Chargee will be final and conclusive.
(c) The Chargor assigns and covenants to assign absolutely to the Chargee all the present and future rent, licence fees, rights and benefits accruing to the Chargor under the Lease, tenancy, grant or licence in respect of the Lease.

The Chargor(s) shall not let out or lease or grant or agree to let out or lease or grant any licence or otherwise howsoever part with the possession or make or accept the surrender of any lease whatsoever of or in respect of the Property or any fixture or any part thereof to any person, firm or company without the consent in writing of the Bank first had and obtained which consent may be given or refused without assigning any reason therefor either absolutely or on such terms and conditions as the Bank deems fit and the decision of the Bank shall be final and conclusive AND it is hereby expressly agreed and declared that the provisions of Section 251 of the National Land Code shall not apply to this Charge.

The Chargor(s) will not let out or lease or grant agree to let or lease or grant any licence or otherwise howsoever part with the possession or make or accept the surrender of any lease whatsoever of or in respect of the said Property or any fixture or any part thereof to any person firms or companies without the consent in writing of MBSB first had and obtained which consent may be given or refused without assigning any reason therefor either absolutely or on such terms and conditions as MBSB deems fit and the decision of MBSB shall be final and conclusive AND it is hereby expressly agreed and declared that the provision of Section 251 of the National Land Code shall not apply to this Charge.

9.2 The consent of the Agent referred to in Clause 9.1 may be refused without assigning any reason therefor or given either absolutely or on such terms and conditions as the Agent deems fit and the decision of the Agent shall be final and conclusive.
9.3 It is hereby expressly agreed and declared that the provisions of Section 251 of the Code shall not apply to this Charge.
