LEGAL RECOURSE. 8.1 Claims, disputes or controversies arising under, out of, or in connection with this Agreement or issues concerning the validity, construction or effect of any patent licensed hereunder shall be resolved in any court having jurisdiction thereof. 8.2 Notwithstanding the foregoing, nothing in this Article shall be construed to waive any rights or time performance of any obligations existing under this Agreement.
