Lessee’s Rights. Lessor grants to Lessee, for the benefit of Lessee and its employees, suppliers, shippers, contractors, customers and invitees, during the term of this Lease, the non-exclusive right to use, in common with others entitled to such use, the Common Areas as they exist from time to time, subject to any rights, powers, and privileges reserved by Lessor under the terms hereof or under the terms of any rules and regulations or restrictions governing the use of the Project. Under no circumstances shall the right herein granted to use the Common Areas be deemed to include the right to store any property, temporarily or permanently, in the Common Areas. Any such storage shall be permitted only by the prior written consent of Lessor or Lessor's designated agent, which consent may be revoked at any time. In the event that any unauthorized storage shall occur, then Lessor shall have the right, without notice, in addition to such other rights and remedies that it may have, to remove the property and charge the cost to Lessee, which cost shall be immediately payable upon demand by Lessor.
Lessee’s Rights. 11.01 The Lessee, upon performing the covenants, promises, agreements, and undertakings herein contained on his/her part, shall and may peacefully possess and enjoy the said Cattle for the duration of this Lease without any interruption or disturbance from the Owner or any person claiming through or under the Owner except as noted in Section 5.05.
Lessee’s Rights. Except (i) as provided in Section 11.2, below, and (ii) to the extent Lessor is required to engage in such communications by Applicable Legal Requirements which are not the subject of a Permitted Lessee Contest and after consultation with Lessee regarding Lessor’s concern that Lessor’s communication with Governmental Authorities is required by Applicable Legal Requirements, but notwithstanding any other provision of this Lease to the contrary:
Lessee’s Rights. If Lessor fails to make any payment or to perform any act expressly required under this Master Lease, and fails to cure the same within the relevant time periods provided in Section 33.1 upon Notice to Lessor but without waiving or releasing any obligation of Lessor, Lessee may (but shall be under no obligation to) at any time thereafter make such payment or perform such act for the account and at the expense of Lessor, and may, take all such action thereon as may be reasonably necessary or appropriate therefor. All sums so paid by Lessee and all costs and expenses (including, without limitation, reasonable attorneysfees and expenses) so incurred, shall be paid by Lessor to Lessee following written demand. The obligations of Lessor and the rights of Lessee contained in this Article shall survive the expiration or earlier termination of this Master Lease.
Lessee’s Rights. During the Lease Term and subject to and in accordance with the terms and conditions of this Agreement:
Lessee’s Rights. 5.2.1 The Lessee shall, to the extent that the same obstructs or interferes with the smooth operations in the Seabed, have the right to restrict: (a) the entry into the Seabed for such period as notified by the Central Government for the purpose of conducting the Survey, construction or operation and maintenance of the offshore wind farm; (b) the navigation of boats, ferries and ships obstructing the conduct of the development of project; (c) the anchoring or use of fixed fishing gears within the Seabed; (d) activities such as scuba diving, windsurfing, kiting and the like, within the Seabed. (e) movement within 50 m (fifty meters) distance from the wind turbine foundation and 500 m (five hundred meters) distance from the sub-station. 5.2.2 Provided, however, that, in the interest of the common public, the Lessee shall permit activities such as fishing for the purpose of livelihood and other activities that may co-exist with the Permitted Activities if they do not affect the normal working of the Permitted Activities. The Lessee shall organize its activities such that they do not unreasonably affect commercial fishing. 5.2.3 Provided also that Defense and Security agency of the Government of India shall have unrestricted right of access to ensure the security of the maritime zone and to enforce the law.
Lessee’s Rights. Lessor, for the consideration herein set forth, further gives, grants, lets and demises unto Lessee, the following rights to conduct activities on the Property related to its contemplated operations (collectively the “Mining Operations”), and any related rights or privileges: a. All the mining rights, easements and privileges as may be reasonably necessary for or incidental to the mining (by all mining methods), removing, development, processing, sale and marketing of the Coal including, without limitation, the right to enter in, upon and under the Property and erect any necessary structures, rooms, mines, tramroads, air shafts, power lines, substations, drains and drainways, and to operate the same therein or thereunder as may be reasonably necessary for the mining, development, excavating and removal of the Coal to market. b. The right to conduct Mining Operations in conjunction with operations on other lands as a single operation, without regard to property lines, and, in particular, to exercise all rights granted hereby in connection with mining from other tracts and other mining and coal related activities, including but not limited to the right to deposit fill, slurry, mine spoil, coal refuse and coal combustion by-products, including, but not limited to bottom ash and fly ash, from whatever origin, on the Property, including in mining voids and abandoned mine works or other voids within the Property. c. With respect to any surface overlying the Property that is now, or in the future, owned by Lessor or its affiliates, Lessor shall, and shall cause its affiliates to, lease such surface property to Lessee for no additional rent or consideration pursuant to a reasonable and customary mining surface lease promptly upon written request by Lessee. Exhibit “C” attached hereto and incorporated herein by reference, is a map indicating the approximate location of all surface property owned by Lessor and its affiliates overlying the Property.
Lessee’s Rights. If at any time or from time to time Lessee desires to enter into or grant any Equipment Lien that otherwise complies with this Lease, and provided that no uncured Event of Default exists, then upon ▇▇▇▇▇▇’s request Lessor shall enter into such customary documentation regarding the Financed FF&E as Lessee reasonably requests, providing for matters such as: (a) waiver or subordination of any right to take possession of such Financed FF&E upon an Event of Default; (b) waiver or subordination of any other right, title, or interest in the Financed FF&E; and (c) agreements to enable the holder of such Equipment Lien to repossess such Financed FF&E if such holder exercises remedies under its Equipment Lien.
Lessee’s Rights. The Lessee shall have no right, title or interest in or to any part of the Aircraft except the rights expressly set out in this Agreement, it being expressly agreed and acknowledged by the Lessee that title to the Aircraft shall remain vested in the Owner subject to the Security Interests arising under the Financing Documents in favour of the Financiers (or any of them).
Lessee’s Rights. 6.1. The Lessee shall be entitled to use the Premises during the whole Lease Period in accordance with the Permitted Use and the terms of this Agreement. 6.2. For the entire Lease Period, the Lessee shall be granted the following rights (at the same time, the Parties express their understanding that such rights are not exclusive and similar rights are granted by the Lessor and other lessees of the Complex): 6.2.1. the right to use the Common Areas to access the Premises in accordance with the Warehouse Use Rules; 6.2.2. the right to use all existing and future Utilities at the Premises; 6.2.3. the right to load and unload goods in special loading and unloading areas at the Warehouse Building, in accordance with the Complex Use Rules; 6.2.4. the right to use such parts of the Warehouse Building and/or the Complex, which will be allocated by the Lessor for placing devices and equipment serving the Premises exclusively; 6.2.5. granted that the Lease Payment has been made in a timely manner and granted that the Lessee provides the Lessor with a list of license plates of cars that may enter the territory of the Complex: 6.2.5.1. the right to park passenger vehicles and trucks at the parking slots in accordance with the Complex Use Rules and Parking Permits; 6.2.5.2. the right to move to and from the Parking Slots, as well as the right to move to the Handling Areas, coursing in strict compliance with the Warehouse Complex Rules. 6.2.6. the right to directly execute a separate agreement for the provision of telecommunications services in the Premises with any telecom operator provided that (a) the Lessor approves such a telecom operator in writing (such approval may not be unreasonably withheld), and (b) such a telecom operator removes all the cables and equipment from the Premises and Warehouse Complex at the end of the Lease Period, unless otherwise agreed by the Parties in writing. 6.3. Given that the Lessee does not materially violate the Agreement, the Lessee shall be granted free and unimpeded access to the Complex, provided to all Lessee’s employees, clients and suppliers in accordance with the Complex Use Rules. 6.4. Nothing in this Agreement shall grant the Lessee any rights or privileges, except for the rights expressly granted to it by this Agreement. 6.5. The Lessee may suspend the activities in the Premises/Part of the Premises upon the onset of circumstances that prevent the Lessee from using the Premises in the event that the such circumstances tha...
