Liability of Subcontractors. Any Subconsultant of the Architectural Designer shall have the same responsibilities and obligations as the Architectural Designer to comply with the provisions of this Paragraph 8.4 and shall be subject to the same penalties for failure to comply as set forth in Paragraph 8.4.4.

Any Subconsultant of the Environmental Consultant shall have the same responsibilities and obligations as the Environmental Consultant to comply with the provisions of this Paragraph 8.4 and shall be subject to the same penalties for failure to comply as set forth in Paragraph 8.4.4.

Any Subcontractor of the ESCO under Subparagraphs 52.14.1, 52.14.2, 52.14.3 and 52.14.4 of this Contract shall have the same responsibility and obligations as the Contractor to comply with the provisions herein, and shall be subject to the same penalties for failure to comply as set forth herein.

Any Subconsultant of the Construction Cost Estimator shall have the same responsibilities and obligations as the Construction Cost Estimator to comply with the provisions of this Paragraph 8.4 and shall be subject to the same penalties for failure to comply as set forth in Paragraph 8.4.4.
Liability of Subcontractors. 1) It shall be the responsibility of the Sponsor to ensure through contractual agreement that any independent contractor, subcontractors, or sub consultants utilized by the Sponsor, defend, indemnify, save, and hold harmless the State and any of their departments, divisions, agencies, officers, or employees who may be obligated to pay by reason of any liability imposed upon any of the above for damages arising out of any error, negligence, omissions, or act of the independent contractor, subcontractor, or sub consultant.
