Lienable Work Sample Clauses

Lienable Work. No renovation, repair, construction, site work or any other mechanic’s lienable work shall be done to or for the benefit of the Property, without Lender’s approval except for normal repair and maintenance.

Lienable Work. No excavation, construction, earth work, site work or any other mechanic's lienable work shall be done to or for the benefit of any Property, without Lender's approval, which shall not be unreasonably withheld, except for normal repair and maintenance in the ordinary course of business and up to $25,000 of work annually at each Property which does not decrease the value of such Property.
Lienable Work. No excavation, construction, earth work, site work or -------------- any other mechanic's lienable work shall be done to or for the benefit of the Project or any part thereof, without Lender's approval (which approval will not be unreasonably withheld), except for (a) normal repair and maintenance in the ordinary course of business and (b) work related to the alteration, replacement, repair and maintenance to a Property not estimated to have an aggregate cost in excess of (i) with respect to the La Casa Property, One Hundred Thousand Dollars ($100,000) or (ii) with respect to the Courtyard Property or the Spring Property, Seventy-Five Thousand Dollars ($75,000).
Lienable WorkNo material excavation, construction, earth work, site work or any other mechanic's lienable work that costs in excess of $125,000 shall be done to or for the benefit of any Property, without Agent's approval, which approval shall not be unreasonably withheld or delayed, except for normal repair and maintenance in the ordinary course of business and except for any such actions which may be taken by a Tenant under the Leases without the consent of Borrowers.

Lienable WorkBorrower shall not, without Lender's prior written approval, exercisable in Lender's sole discretion, permit any mechanic's lienable work to be done to or for the benefit of the Project except a) as disclosed in the Leases approved by Lender, b) for normal repair and maintenance (excluding any capital improvements or replacements) in the ordinary course of business or c) emergency repairs. No capital improvements or replacements of any capital items in the Project that would cost more than the lesser of 10% of the Loan amount attributed to any Premises location or 10% of the Loan amount outstanding in the aggregate at any time shall be commenced without Lender's prior written approval of the scope of work the plans and specifications, the contractor, the construction contract, the costs (including the costs of installation, labor and materials), the timing and manner of payment and the sources of funding thereof.
Lienable Work. If any portion of the Escrow Deposit is to be paid to any party that would have lien rights against the Property, Escrow Agent shall, prior to making any such payment, comply with the following: (a) Escrow Agent shall have first received lien waivers, contractor's sworn statements and/or such other documents and certificates as may be required to evidence that all lien rights related to the work, item or service being paid for have been waived or released under applicable mechanic's, materialman's, broker's or other similar lien laws; and (b) Escrow Agent shall have first provided Lender with an endorsement (which shall be paid for by Borrower) to Lender's title policy insuring against any such lien.

Borrower will not consent to any request by Tenant to perform any work at the Project which could create liens on the Project, without Lender's consent, which will not be unreasonably withheld.
