Common use of Limitation on Leases Clause in Contracts

Limitation on Leases. The Borrower will not, and will not permit any other Loan Party to, create, incur, assume or suffer to exist any obligation for the payment of rent or hire of Property of any kind whatsoever (real or personal but excluding Capital Leases to the extent such Capital Leases do not go beyond the value and terms of the leased property and leases of Hydrocarbon Interests), under leases or lease agreements which would cause the aggregate amount of all payments made by the Borrower and the other Loan Parties pursuant to all such leases or lease agreements, including, without limitation, any residual payments at the end of any lease, to exceed $15,000,000 in any period of twelve consecutive calendar months during the life of such leases.

The Borrower will not, and will not permit any other Loan Party Subsidiary to, create, incur, assume or suffer to exist any obligation for the payment of rent or hire of Property of any kind whatsoever (real or personal but excluding Capital Leases to the extent such Capital Leases do not go beyond the value and terms of the leased property and leases of Hydrocarbon Interestspersonal), under leases or lease agreements (excluding Capital Leases, Synthetic Leases, leases of Hydrocarbon Interests, and leases of compressor equipment) which would cause the aggregate amount of all payments made by the Borrower Credit Parties and the other Loan Parties each of their respective Subsidiaries pursuant to all such leases or lease agreements, including, without limitation, any residual payments at the end of any lease, to exceed $15,000,000 US$2,500,000 in any period of twelve consecutive calendar months during the life of such leases.
