The PERFORMING PARTY agrees the requirements of the UGMS apply to the PERFORMING PARTY and matters relating to this Contract, including the criteria for Allowable Costs.
Local Governments. Local governments (as defined in NRS §332.015) may join or use this or any contract resulting from the underlying RFP subject to all terms and conditions thereof pursuant to NRS §332.195. The State is not liable for the obligations of any local government which joins or uses this or any contract resulting from this Participating Addendum.
Local Governments. The Recipient shall ensure that LGs: (i) incorporate nutrition and nutrition indicators in the LDP; (ii) select the villages in which interventions will be carried out; (iii) select one CEA to which it will contract out the community- based nutrition interventions; (iv) prepare Subproject proposals and send the same to CLM for approval; and (v) monitoring activities and reporting to the CLM.
Local Governments. (i) assess the powers of the local governments to borrow money; (ii) review whether prior approval/sanction of the state government is needed from time to time to borrow or re-borrow and take upon itself the interest liability arising out of term loans or bond issuances; (iii) review the provisions of the governing act relating to repayment of loans, permissible security to lenders against loans such as establishment of sinking (iv) assess trends in revenues and expenditure and reasons for variations, if any; (v) assess proportion of non-tax revenues in the overall revenue base, level of dependence on state governments for fiscal transfers, extent of cost recovery and expenditures incurred in operations and maintenance; (vi) review of the debts outstanding for the local governments; and (vii) assess debt service coverage ratio (DSCR) and interest coverage ratio (ICR) which should ideally have a value of at-least 1.25 on a year-over-year basis. In case of lower DSCR and/or ICR additional credit enhancement measures in the form of guarantees, debt service reserve accounts, etc need to be provided for.

Local Governments. The Borrower, through the PIU, shall ensure that each Local Government shall submit a Commitment Letter to the PIU , satisfactory to the Bank, as a condition for such Local Government to participate in the Project as a Pilot Local Government. No Advance Payment or Reimbursement may be made with respect to any Local Government which has not entered into a Commitment Letter. Each Commitment Letter shall set out, inter alia: (a) the Pilot Local Government’s obligations to: (i) deliver the Outputs in accordance with the financial and technical conditions and the standards for budgeting, planning, procurement, contract management and financial management set out in the Technical Guidelines; (ii) comply with environmental and social safeguards technical and reporting requirements set out in the Technical Guidelines and the Supplemental Technical Guidelines (Environmental and Social Safeguards); (iii) comply with the Anti- Corruption Guidelines applicable to recipients of Loan proceeds other than the Borrower and the Anti-Corruption Action Plan;
