Common use of Mandatory Court Appearances Clause in Contracts

Mandatory Court Appearances. a. An employee subpoenaed to appear as a court witness shall be excused from his/her work assignment without loss of pay, provided that the employee shall submit any witness fee received to the School District Business Office along with a copy of the subpoena. In cases where the employee is a plaintiff or defendant to the action, absence will be without pay or, at the employee’s election, emergency leave as provided in Paragraph 4.
