The State of New Mexico requires that all materials shall be new and of the highest quality and at the best attainable price available for the type of work being performed. No used materials shall be used on the project. Recycled materials specifically prepared for reuse to meet “LEED” certification may be permitted, with the User Agency’s approval.

Materials and Parts. Parts may be picked up at supplier by County and billed directly to City by the supplier, provided however, that the cost of pickup shall be included in the labor costs listed above. County may supply parts from Snohomish County Airport Fire Department stock and bill City for parts with labor charges. Sales Tax: City shall pay sales tax on all labor and parts to County. County shall collect and remit the sales tax to the State Department of Revenue at the current applicable rate. The sales tax rate is currently 10.5%. Invoices are due and payable within (30) days of the date of the invoice. The County shall maintain records of all services provided and such records shall be available for inspection or audit by the City, upon reasonable notice, during the County's regular business hours. Total invoices shall not exceed the sum of $400,000.00 over the term of the contract. Materials and Parts. A. The Bidder’s service vehicles must be fully stocked with basic materials and standard parts so that response to normal repair calls can be accomplished without returning to the shop. B. Parts and materials used by the Bidder shall be new, unless otherwise specified and approved by the City’s Representative and they must meet or exceed the applicable manufacturers’ specifications and standards. C. All materials and tools furnished by the Bidder shall be in proper working order and not cause damage to City property.

Materials and Parts i) If spare materials and replacement parts are unavailable from City inventory, County shall provide spare materials and replacement parts as necessary to repair a signal that is deemed by the City to create a dangerous condition. Materials and parts supplied by County will be charged to City at current replacement costs with associated shipping and handling fees necessary to replace County inventory. ii) The County shall assist City with developing a recommended inventory list of spare materials and replacement parts to store/maintain on a regular basis.

Materials and Parts not in process: In the event that CMS wishes to terminate any or all Products specified in the Forecast or Purchase Orders and such termination exceeds ▇▇▇▇▇▇ Group’s cancellation period, CMS shall be liable for materials and parts procured to support the Forecasts or Purchase Orders, but not yet in process, at an amount equal to the direct cost of the materials and parts plus 25%. ▇▇▇▇▇▇ Group, however, agrees to make commercially reasonable attempts to minimize CMS’S liability by reallocating standard materials and parts to other ▇▇▇▇▇▇ Group customers. ▇▇▇▇▇▇ Group shall have no responsibility to attempt to reallocate any unique material that was procured solely to support CMS’s order. ▇▇▇▇▇▇ Group’s time, if any, expended to reallocate standard materials and parts will be compensated to ▇▇▇▇▇▇ Group by CMS at ▇▇▇▇▇▇ Group’s standard rates.
