Merchandise and Services. Subject to the terms of this Contract, Purchaser agrees to purchase the Cemetery Merchandise and Services at the current retail price established herein by paying Seller in the manner set forth in this Contract (Sections I & II), and upon the death of the Contract Beneficiary, the Seller shall furnish the Cemetery Merchandise and Services as set forth in the Statement of Cemetery Merchandise and Services Selected above, regardless of the cost of the merchandise or service at the date of the death of the Contract Beneficiary (see Disclosures 4 & 5). The Provider will be entitled to all life insurance or annuity proceeds (Section II), except for amounts in excess of the cost of Merchandise and Services provided at the time of fulfillment (the Contract Beneficiary’s death). This Contract provides benefits in the form of Cemetery Merchandise and Services only, unless Non-Guaranteed Cash Advance Items are specified above. Prior to selecting the Cemetery Merchandise and Services, Purchaser acknowledges receipt of the General Price List, and that the Casket Price List and the Outer Burial Container Price List were made available to him/her. (2) All promotional material, regardless of media format (i.e. printed, electronic, broadcast media), provided to the public by the Concessioner in connection with the services provided under this Contract must be approved in writing by the Director prior to use. All such material will identify the Concessioner as an authorized Concessioner of the National Park Service, Department of the Interior. (3) The Concessioner, where applicable, will develop and implement a plan satisfactory to the Director that will assure that gift merchandise, if any, to be sold or provided reflects the purpose and significance of the Area, including, but not limited to, merchandise that reflects the conservation of the Area's resources or the Area's geology, wildlife, plant life, archeology, local Native American culture, local ethnic culture, and historic significance.

Merchandise and Services. During the term hereof, Licensee shall maintain in said Department a complete stock of merchandise to be sold therein, the quantity and quality thereof being subject to the approval of Sears. The merchandise and services to be sold in said Department shall be sold to the public at reasonable prices. Licensee expressly covenants that such prices shall not exceed those of competitors for merchandise and services of a quality similar to those offered for sale in said Department and that prices shall be plainly marked on all merchandise offered for sale in said Department.
