Misapplication of Funds. Distribute any revenue from the Property or any Proceeds in violation of the provisions of this Agreement, fail to remit amounts to the Collection Accounts or Holding Account, as applicable, as required by Section 3.1, misappropriate any security deposit or portion thereof or apply the proceeds of the Loan in violation of Section 2.1.4; or
Misapplication of Funds. Distribute any Rents or Moneys received from Accounts in violation of the provisions of Section 2.12, or fail to pledge any security deposit to Lender, or misappropriate any security deposit or portion thereof.

Borrower shall not (a) distribute any Loss Proceeds in violation of the provisions of this Agreement (and shall promptly cause the reversal of any such distributions made in error of which Borrower becomes aware), or (b) misappropriate any security deposit or portion thereof.

Neither Borrower nor Operating Lessee shall (a) distribute any Revenue or Loss Proceeds in violation of the provisions of this Agreement (and shall promptly cause the reversal of any such distributions made in error of which Borrower becomes aware), (b) fail to remit amounts to the Cash Management Account as required by Section 3.1, or (c) misappropriate any security deposit or portion thereof.

Permit Mortgage Borrower to distribute any revenue from the Property or any Proceeds in violation of the provisions of the Loan Agreement (Mortgage), permit any Senior Mezzanine Borrower to distribute any Receipts from its Senior Mezzanine Ownership Interests in violation of the provisions of its Senior Mezzanine Loan Agreement, distribute any Receipts from the Ownership Interests in violation of the provisions of this Agreement, fail to remit amounts to the Mezzanine Account, as applicable, as required by Section 3.1, permit Mortgage Borrower to misappropriate any security deposit or portion thereof or apply the proceeds of the Loan in violation of Section 2.1.4; or
Misapplication of Funds. Distribute any Gross Revenue or Moneys received from any Leases in violation of the provisions of this Agreement and the other Loan Documents.

(i) Distribute any revenue from the Property or any Proceeds in violation of the provisions of this Agreement, (ii) fail to remit amounts to the Mezzanine Account, as required by Section 3.1 or (iii) the Pledge, misappropriate any security deposit or portion thereof or misapply the proceeds of the Loan; or
Misapplication of Funds. The Collateral Agent agrees that any funds incorrectly paid to it by the Borrower shall be promptly returned to the Borrower upon receipt of written notice from the Borrower that such funds were incorrectly paid to the Collateral Agent prior to the Collateral Agent's transfer of such funds in accordance with this Agreement. The Collateral Agent shall be completely protected against any liability for returning such funds in reliance on such written notice that funds were incorrectly paid.
