Most Favored Nations Clause. The Guild agrees that if, during the term of this Agreement, it enters into a contract with any Producer whose business is comparable to and in competition with the Producer herein, granting to such other Producer more favorable rates, terms or conditions of employment than those provided for in this Agreement, the Guild will notify the AICP, and the AICP shall have the option to adopt such more favorable rates, terms or conditions. The above terms in this paragraph 5 do not apply to the DGA Midwestern Commercial Agreement.
Most Favored Nations Clause. Section 1. Should the Union enter into a written Agreement(s) with any other employer or association which provides better wages and/or terms and conditions of employment, then such wages and/or terms and conditions of employment shall automatically apply to the Employer signatory to this Agreement, the only exception is to first time organized contractors working on specified project(s) they have under a signed contract.
Section 2. In the event that any question arises as to the meaning and application of this provision, either party may file with the other a written complaint. Such complaint will be initiated in accordance with Article XIII of this Agreement - Grievance and Arbitration Procedure.
Most Favored Nations Clause. Should the Union at any time during the existence of this Agreement grant more favorable conditions to any contractor including, but not limited to, Health & Welfare or Defined Benefit Pension, the Union agrees to grant those same conditions to all contractors signatory to this Agreement. This section does not pertain to Section 112 (Work Preservation).
Most Favored Nations Clause. If the Authority shall ever allow a provider of a loan, credit or liquidity for any of the Authority’s obligations on parity with the Notes to have the benefit of any type of “most favored nations” or “most favored lender” provision then the Bank shall immediately have the benefit of such provision and such provision shall be considered incorporated into this Agreement for the benefit of the Bank; provided however, that prior to the effectiveness of any such provision, the Bank shall obtain written confirmation from the Rating Agencies then rating the Notes that such provision is not the basis for such rating agency to reduce, withdraw, suspend or place on negative credit watch the ratings on the Notes. The Authority hereby confirms that no current loan, credit or liquidity facility for its obligations on parity with the Note contains a “most favored nations” or “most favored lender” clause. Notwithstanding anything herein to the contrary, this Section 6.20 shall not apply to any agreements now in effect or hereinafter entered into with the Texas Comptroller of Public Accounts or its affiliates.
Most Favored Nations Clause. It is the intent of the Union that this Agreement will establish standard wages, hours, terms, and working conditions to prevail within the Union's geographic jurisdiction for all work of a type covered by this Agreement, except in those instances where the International Union otherwise directs or where the Union has previously established a different bargaining history with another association of Employers. The Union does not intend to enter into any agreement with any Employer not covered by the foregoing exceptions which contains better language or conditions.
Most Favored Nations Clause. If the Union shall enter into any agreement different in its term(s) from this Agreement for any type of work covered by this Agreement, with any Employer or group of Employers, any Employer signatory hereto shall have the right to avail itself of such different term(s) of such agreement. This clause shall not apply to an agreement where the only difference is the length of the agreement, such as a project agreement or an agreement for a lesser specific time period so long as it is approved by the Association.
Most Favored Nations Clause. In the event that the President’s Office of the Federation enters into a collective bargaining agreement with any other public broadcasting station or agency which provides for rates or conditions more advantageous to the latter than those provided therein, such other rates or conditions shall be automatically substituted for those herein effective as of the beginning date hereof.
Most Favored Nations Clause. The Union shall request the consent of the NCMCMBA to any agreement by the Union to grant to any employer or Employer Association conditions more favorable than those set forth in this Agreement. Should the Union not obtain such consent in writing from the NCMCMBA then, and only then, the Union shall grant those same conditions to all contractors signatory to this agreement. If the Union grants more favorable conditions to any employer or employer association without the written consent of the NCMCMBA, the Union shall immediately notify the Association of same.
Most Favored Nations Clause. The Union agrees that in the event it grants more favorable terms or conditions, other than those contained in this agreement, to any employer or association, the Union will extend those same terms and conditions to the parties to this Agreement. The Union further agrees that it will not enter into any project labor agreements or side letter agreements that contain more favorable terms than those contained in this Agreement without offering those same terms to the parties to this Agreement. If any project labor agreement or agreement to grant relief on a particular project contains more favorable terms, the offering of those terms to other contractors will be limited to that particular project.
Most Favored Nations Clause. DIGEX will assure LCI of the status of a --------------------------- "Most Favored Customer" (as defined below) for existing Services and new services maintained or ordered during the Term of the Agreement. "Most Favored Customer" is defined as the understanding between the Parties that the prices, contractual and business benefits offered by DIGEX to LCI shall be comparable to or better than the prices, business and contractual benefits provided to other DIGEX customers, having similar or less volume commitments (including resellers) and purchasing similar Services. In the event that DIGEX shall fail in this regard as determined by (the "Audit") set forth in section 10.3 below, DIGEX shall credit LCI the required difference for the period of time LCI did not receive Most Favored Customer status and provide LCI the pricing, contractual, and business benefits not received.
