Negotiated Rates. At any time during the third quarter of Contract Year 3, if the Parties have not adopted *, ACC may (but shall not be obligated to) initiate, by notice to AWS, a 30-day period of roaming rate and exclusivity negotiations, provided, that such 30-day period must be commenced and completed within the third quarter of Contract Year 3. If negotiations are initiated by ACC, both Parties will negotiate in good faith to seek to agree on fair and reasonable GSM and GPRS roaming rates and exclusivity provisions for Contract Years 4 and 5.
Negotiated Rates. (a) Negotiated Monthly Base Reservation Rate(s): $13.6875/Dth. of MDQ (b) Negotiated Base Commodity Rate(s): $.0049/Dth.
Negotiated Rates. Notwithstanding anything to the contrary contained in this Tariff, Transporter and Shipper may, as provided in § 27 of the General Terms and Conditions, negotiate a rate for service under this Rate Schedule. Transporter's rates, as shown on its Statement of Rates, are available as recourse rates for any Shipper that does not desire to negotiate a rate with Transporter. An agreement by the Shipper to accept a Negotiated Rate does not, in any manner, restrict the Shipper's right to elect recourse rates for other services not covered by the negotiated-rate agreement. This provision, in and of itself, does not allow Transporter and Shipper to negotiate terms and conditions of service.
Negotiated Rates. Negotiated Rates for Zones 1 and 2, as such Zones are defined in MEP’s FERC Gas Tariff, as may be revised from time to time (“Tariff”):
(a) Negotiated Monthly Base Reservation Rate for Zone 1: $ 7.9235 /Dth of MDQ, and
(b) Negotiated Monthly Base Reservation Rate for Zone 2: $ 7.9235 /Dth of MDQ and
(c) Negotiated Base Commodity Rates:
Negotiated Rates. If negotiations are initiated by Dobson, both Parties will negotiate in good faith to seek xx xxxee on fair and reasonable TDMA roaming rates and exclusivity provisions for Contract Years 4 and 5.
Negotiated Rates. If the Indian Health Care Provider (IHCP) can negotiate such agreements with third party providers, the Indian Health Care Provider (IHCP) may pay third party providers less than Medicaid fee-for-service rates.
Negotiated Rates. The Parties mutually acknowledge that the rates for transport and termination of Reciprocal Compensation Traffic and Transit Traffic, and any percent of use factors agreed to by the Parties in order to determine traffic type, as specified in Exhibit B, are voluntarily negotiated rates and factors, pursuant to Section 252(a)(1) of the Act, and may differ from the rates and factors that would be imposed by a regulatory agency under Section 252(d)(2) of the Act. Accordingly, a regulatory determination that CTCO’s costs of transport and termination are either higher or lower than the rates agreed to, or a regulatory determination that traffic types are different than the mutually-agreed upon factors, shall not constitute an event requiring negotiation under Section 9.1 of the Agreement. To the extent a law, rule or order expressly requires a change to a rate or factor then both the rate and factor will be renegotiated.
Negotiated Rates. The parties agree that the rates payable under the FTSA (as set forth on Exhibit “C” of this Loop Agreement) are "negotiated rates" in accordance with the FERC's Policy Statements on negotiated rates and the applicable provisions of WIC's Tariff. Should the FERC or a court determine, by order, change in policy or otherwise, that WIC may not collect the rates provided for herein, then the parties agree to enter into a substitute lawful arrangement such that the parties are placed in the same position as if WIC had collected such rates.
Negotiated Rates. On August 11, 2014, the Commission issued an “Order Issuing Certificate” in Docket No. CP14- 18-000 (“August 11 Order”) granting Transco a certificate of public convenience and necessity to construct and operate the Woodbridge Delivery Lateral Project (“Project”), approximately 2.4 miles of pipeline and associated facilities to provide 264,000 dekatherms per day of firm transportation service to serve the Woodbridge Energy Center, an electric generating facility being developed in Woodbridge, New Jersey.2 The instant filing is made in compliance with ordering paragraph (E) of the August 11 Order. Pursuant to the Commission’s negotiated rate policies3 and Transco's negotiated rate tariff provisions approved by the Commission,4 Transco submits the Service Agreement for filing with the Commission. The Service Agreement includes the negotiated rate (the negotiated rate and all applicable charges), the exact legal name of the customer, the receipt and delivery points, the quantity of gas to be transported, the agreement termination date, and the applicable rate schedule for the service.
