Federal awarding agencies and recipients are subject to the regulations implementing 2 CFR §200.215 “Never Contract with the Enemy.” The regulations in 2 CFR §200.215 affect covered contracts, grants and cooperative agreements that are expected to exceed $50,000 within the period of performance, are performed outside the United States and its territories, and are in support of a contingency operation in which members of the Armed Forces are actively engaged in hostilities.
