Non-Collection Notice. The CONTRACTOR shall not be required to collect any Solid Waste, Bulk Waste, or Recyclable Materials, within reason, which does not meet the requirements in this Agreement. The CONTRACTOR shall collect that portion of Solid Waste, Bulk Waste, or Recyclable Materials that meets the set-out requirement, and shall affix to the improper Garbage Can, Container, Bag, or other material a Non-Collection Notice explaining why Collection was not made. The TOWN shall approve the design of said notice and the cost of printing said notice shall be borne by the CONTRACTOR. The CONTRACTOR shall maintain a record of the address of any Customer where Solid Waste, Bulk Waste, or Recyclable Materials were not collected, the date of non- collection, and the reason they were not collected, to be provided to the TOWN upon request.

If not collected, FRANCHISEE shall immediately place a notice on the cart, bin or waste explaining why the material was notcollected. 3.8.2 The design and content of the non-collection notice used by the FRANCHISEE shall be subject to the approval of the Environmental Manager. At a minimum, the notice shall provide the following information regarding the non-collection event: date, reason for non-collection,information that will allow the customer to correct the problem for future Collections, and a local customer service telephone number for questions.

Those materials which are capable of being composted and which 247 would otherwise be process as Recyclable Material or disposed of as Garbage. Organic Waste 248 includes any vegetative matter resulting from normal yard and landscaping maintenance that is 249 not more than three (3) feet in its longest dimension or six (6) inches in diameter. Organic Waste 250 includes plant debris, such as palm, yucca and cactus, grass clippings, leaves, pruning, weeds, 251 branches, brush, holiday trees, and other forms of vegetative waste. Organic Waste also includes 252 Food Waste, Stable Matter, and food packaging items such as pizza boxes, paper towels, waxed 253 cardboard and food contaminated paper products. Organic Waste does not include items herein 254 defined as Exempt Waste.
