Non-Exclusive Access. Following the expiration of the -------------------- Exclusive Evaluation Period for a Project Data Set, GENENTECH shall continue to have non-exclusive access to such Project Data Set solely through the GeneScape(R) database and solely for the purpose of identifying Clones of interest to GENENTECH in such Data Set, or to the extent otherwise set forth in an executed subscription agreement. However, the preceding restriction shall not apply to any information which becomes part of the public domain other than as a result of a disclosure by GENENTECH in violation of this Agreement, an executed License Agreement or an executed subscription agreement.

Non-Exclusive Access. Marketing Representative is not restricted by the Agreement from allowing any competitive local exchange carrier (“CLEC”), video service provider, or other service provider to have access to the Property or provide services to Residents. Residents may select another service provider of their choice and Marketing Representative shall not, in any manner, inform its Residents that they are restricted to using Verizon as their sole service provider.

Non-Exclusive Access. The Company and Tejon, as appropriate, shall provide non-exclusive access to the Mitigation Land through the Master Project and the Balance of the Ranch, respectively, if such access is required by the appropriate governmental agency; provided, however, that such non-exclusive access shall not in any way materially interfere with or affect the Company’s or Tejon’s ownership, operation, construction or development of the Master Project or the Balance of the Ranch. It is the Members’ intent that such access shall be provided through existing rights-of-way and that the Company and Tejon shall have no obligation to construct any improvements in connection with such access, to provide the public with rights of access to the Balance of the Ranch, or to otherwise incur any cost or expense in connection with providing such access. Further, the Members acknowledge that the Mitigation Land shall be conveyed subject to a conservation easement in favor of the Conservancy in accordance with the Ranch-Wide Agreement, which conservation easement provides for public access rights.

August 12, 2021 – thereafter – Teachers’ return to school. Teachers have access to property; and e. August 23, 2021 – thereafter – Students’ first day back to school. Students have full access to Property.

Non-Exclusive Access. Nothing contained herein shall be construed to preclude Owner or Owner from enjoying full access to the Premises for the proper management of all wildlife activities, ensuring the Premises is being used in a manner consistent with the Conservation Purposes, and the construction, repair, and supervision of dikes, dams, and the flooding of such areas, or fencing portions of the Premises for the betterment of wildlife habitat; provided, however, that nothing in this subsection D shall be interpreted to create any obligations on Owner or Owner to repair, maintain or monitor the Premises.
Non-Exclusive Access. Concurrently with the acquisition of the Lands by The City, The City shall grant the Development Manager non-exclusive and unimpaired access to the Lands for the purpose of performing its obligations under this Agreement. The Development Manager may, for any purpose in furtherance of the Project, grant a right of access to the Project Architect, Contractors, Subcontractors and Consultants necessary to complete the Project and its agents and employees in respect of the Lands, but no such right of access shall have effect beyond the expiry or termination of this Agreement.
