Common use of Non-Payment by Trust Clause in Contracts

Non-Payment by Trust. Except as otherwise provided herein, the Liquidity Agent shall not be liable to any of the Lenders for any amounts not actually received from the Trust. In the event of the non- payment of any amounts required to be paid pursuant to this agreement, the Lenders shall not be obligated to make further disbursements and the Liquidity Agent on behalf of the Lenders shall deal with such default in the manner set forth in this agreement.
