Nonexclusive Appointment. Nothing in this Agreement shall prevent JPMorgan or any affiliated person (as defined in the 1940 Act) of JPMorgan from prxxxxxxx services for any other person, firm or corporation (including other investment companies); provided, however, that JPMorgan expressly represents that it will undertake no activities which, in its judgment, will adversely affect the performance of its obligations to the Trust under this Agreement.
Nonexclusive Appointment a. Manufacturer appoints Dealer as a non-exclusive dealer for the marketing, sale, installation, service and maintenance of the Manufacturer’s PALS and ATLAS systems, and the related Products and Software employed by such systems, in the Territory.
Nonexclusive Appointment. The Supplier hereby appoints the Distributor to distribute, offer for sale,and sell the Supplier's products listed in Exhibit A (the "Products"), in the Territory (as defined in section 1) on a nonexclusive basis, and the Distributor accepts this appointment. Nothing contained in this agreement limits the Supplier's right, in its sole discretion, to discontinue the manufacture, sale, or distribution of any Product at any time.
Nonexclusive Appointment. Jato hereby appoints Partner, and Partner hereby accepts the appointment, as a nonexclusive wholesaler of Jato to promote the services as further provided herein. The Parties understand that this appointment is non-exclusive and that Jato may appoint other representatives, including without limitation value added resellers, and may use its own direct sales personnel to promote their own respective services other than to Customers.
Nonexclusive Appointment. Reseller is hereby appointed a nonexclusive value-added reseller of the Products pursuant to this Agreement. Reseller accepts such appointment and agrees to serve as a value-added reseller of the Products to end users as provided herein. This Agreement is not exclusive to Reseller, and Developer reserves the unrestricted right to sell, license, market and distribute or to grant to others the right to sell, license, market and distribute the Products and value added versions thereof anywhere in the world.
Nonexclusive Appointment. Partner is hereby appointed as a nonex- clusive Approved Partner for the purpose of valued added reselling of Net Integrator Servers (herein referred to as the “Products”), in North America, pursuant to this Agreement. Partner accepts such appointment and agrees to serve as an Approved Partner of the Products to end users as provided herein. This Agreement is not exclusive to Partner, and NITI reserves the unrestricted right to sell, license, market and distribute or to grant to others the right to sell, license, market and distribute the Products and value added versions thereof, anywhere in the world.
Nonexclusive Appointment. Upon acceptance of this Agreement by Developer, Reseller is hereby appointed a nonexclusive reseller of the Software pursuant to this Agreement. Reseller accepts such appointment and agrees to serve as a reseller of the Products to end users as provided herein. This Agreement is not exclusive to Reseller, and Developer reserves the unrestricted right to sell, license, market and distribute or to grant to others the right to sell, license, market and distribute the Software and value added versions thereof anywhere in the world.
Nonexclusive Appointment. This appointment of Fabricator as an Approved Factory Fabricator is not exclusive. Nothing shall preclude ICD from appointing other approved factory fabricators for the conduct of business in any locality.
Nonexclusive Appointment. Nothing in this Agreement limits in any way the rights of The Company to appoint, authorize or utilize any other Sales Consultants, representatives, or other third party distributor or agent with respect to the promotion and/or sale of the The Company’s products or other competitive activities or to reach out and close prospective customers directly.
Nonexclusive Appointment. VAR is hereby appointed a nonexclusive value-added reseller of the Products for sale pursuant to this Agreement. VAR accepts such appointment and agrees to serve as a value-added reseller of the Products to end users as provided herein. This Agreement is not exclusive to VAR, and Nagios reserves the unrestricted right to sell, license, market and distribute or to grant to others the right to sell, license, market and distribute the Products and value added versions thereof anywhere in the world.
