Nonrefundable. Subject to InsynQ's substantial performance of its obligations as set forth in this Agreement, all amounts received by InsynQ hereunder shall be nonrefundable.
Nonrefundable. Once paid, none of the commitment fees or other fees provided for in this Section 2.04 shall be refundable under any circumstances.
Nonrefundable. All payments made by ROCHE to SYNTA under this Agreement shall be non-refundable and non-creditable, except as expressly set forth in Sections 2.5.2(f), 2.5.4 and 7.9.2.

In other words, whether or not a JVP exercises its option or elects to participate in any Prospect or the drilling or completion of any well located within any Prospect, the Option Price paid by each JVP is the sole property of Pohle and is paid in consxxxxxtion of the options granted under the terms of this Agreement.
Nonrefundable. No portion of any of the above fees or expenses shall be refundable under any circumstances, including prepayment, repayment or acceleration of the Loans with respect to which such fees are due or have been paid.
Nonrefundable. Subject to CASTALINK's substantial performance of its obligations as set forth in this Agreement, all amounts received by CASTALINK hereunder shall be nonrefundable.
Nonrefundable. The amount payable pursuant to Section 4.1 is nonrefundable for any reason, including the case that one or more of the i2 Licensed Patents are found to be invalid or unenforceable.
Nonrefundable. No Fees, portion of the Fees, or other fees payable by AVP or Member under this Agreement will be refunded to AVP or Member upon suspension or termination of this Agreement for any reason whatsoever.
