Common use of Nontermination and Nonabatement Clause in Contracts

Nontermination and Nonabatement. Except as provided herein, no destruction or damage to the Premises by fire, flood or other casualty, whether insured or uninsured, shall entitle Cinelux to terminate this Agreement. Town and Cinelux waive the provisions of any statutes which relate to termination of a lease when leased property is destroyed and agree that such event shall be governed by the terms of this Agreement.
