Nothing contained in this Article shall be construed as obliging a Contracting State to grant to persons not resident in that State any personal allowances, reliefs, reductions and deductions for taxation purposes which are by law available only to persons who are so resident.
Nothing contained in. Article Four shall preclude an employer from preassembling and prefabricating the following:
1. Temporary elevators 2. Residence elevators 3. Dumbwaiters
Nothing contained in this Section 2 shall prohibit the Executive from serving as a director of any other corporation not in direct competition with the Bank (subject to the Bank's approval which will not be unreasonably withheld), or from owning or controlling shares of stock in any other corporation, whether or not the capital stock thereof is publicly traded (including a corporation that is in direct competition with the Bank, the Company or any subsidiaries or affiliates thereof, if the stock of such competing corporation is publicly traded and the Executive does not beneficially own more than one percent (1%) of the outstanding shares of such stock).
Nothing contained in this Section 24 shall, or shall be deemed to, prevent Company from making an offer to acquire the Business at any time, even if Company has previously elected not to acquire the Business under Section 24.3.10. If any such offer is made, Bottler shall have no obligation to accept it.
Nothing contained in this Section 1.3 shall limit or ----------- impair Lessor's or Tenant's rights, duties and obligations under the Indemnity Agreement (as defined in Section 2.1 below). -----------
Nothing contained in this Clause shall prevent a Union Industrial Officer from either representing its members or raising matters directly with management at any stage of the grievance procedure. Enterprise Bargaining Agreement Dispute Resolution:-
Nothing contained in this Declaration shall permit the amendment of this Declaration to impair the exemption from personal liability of the Shareholders, Trustees, officers, employees and agents of the Trust or to permit assessments upon Shareholders. Expenses of the Trust charged directly to Shareholders pursuant to Section 3.8 hereof or fees or sales charges payable upon or in connection with redemptions of Shares pursuant to Section 7.1 hereof shall not constitute "assessments" for purposes of this Section 8.3(b).
Nothing contained in this Section 10 will limit the right of the Bank to demand full or partial payment of the Credit Line Obligations, in its sole and absolute discretion and without cause, at any time, whether or not an Event has occurred and is continuing,.
Nothing contained in. 11.3.1 clause 11.1 shall prevent any Warrantor nor any Bridgepoint Seller (nor any of their Affiliates) from:
11.3.1.1 being the holder or beneficial owner, by way of bona fide personal investment, of any class of securities in any company if such class of securities is listed, or dealt in, on a recognised investment exchange (within the meaning of Part XVIII of the Financial Services and Markets Act 2000) provided that he neither holds nor is beneficially interested in more than a total of 5% of any single class of the securities in that company; or
11.3.1.2 in the case of Xxxxxxx Xxxxxxx only, continuing as a director and having an interest in BluGlass Limited; or
11.3.2 clause 11.1 or clause 11.2 shall prevent any Warrantor or Bridgepoint Seller from placing or procuring the placing of any recruitment advertisement for employees and communicating with or recruiting, employing or otherwise contracting with any Person who responds to such an advertisement.
Nothing contained in. Section 6.10 shall prohibit FKF or the Board of Directors of FKF from complying with FKF’s obligations required under Rules 14d-9 and 14e-2(a) promulgated under the Exchange Act; provided, however, that any such disclosure relating to an Acquisition Proposal shall be deemed a change in the FKF Recommendation unless the Board of Directors of FKF reaffirms the FKF Recommendation in such disclosure.
