Common use of Notice of Transfer and Reassignment Clause in Contracts

Notice of Transfer and Reassignment. Transfer and reassignment will be done only after consultation with the affected principal, at which time an explanation of how the move is in the best interest of the District will be shared. When a transfer is made during the school year, the district will make every effort to provide at least five (5) days notice in advance of the transfer. Notwithstanding this provision, the District maintains its managerial authority with respect to transfer and reassignment and the decision to transfer or reassign is not subject to the grievance procedure. However, upon notice from the Association of the District’s failure to follow the procedure set forth above, the District shall have five days to hold a remedial meeting with the principal and a representative from the Association to provide the explanation, the required notice and to consider any information from the principal regarding concerns about the transfer or reassignment. If the district fails to follow this remedial procedure within five (5) days of receiving notice from the Association, the Association may file a grievance beginning at Step 2.
