Number of Students and Grades Served. Subject to the restrictions set forth in Appendix II, the School shall serve students in grades 4-8. The School will have a maximum total enrollment of 375.

Number of Students and Grades Served. The School shall serve the number of students (Year 1 – 144; Year 2 – 320; Year 3 – 364; Year 4 – 546; Year 5 - 728) and grade levels (Year 1 – K-3; Year 2 – K-7; Year 3 – K-8; Year 4 – K-8; Year 5 – K-8) as set forth in Appendix I and such amendments to these numbers and grade levels as may from time to time be approved by the Sponsor. If the planned enrollment decreases by 30% or more of the projected numbers in any given year, School will notify Sponsor at least twenty (20) days prior to the beginning of school in that year. If this occurs, Sponsor may require School to submit a revised budget, including cash flow, and staffing plan. School’s failure to do so within twenty (20) days of Sponsor’s request will constitute just cause for termination of this Charter.
Number of Students and Grades Served. The School shall serve the number of students as set forth in Attachment 1 and subsequent amendments to this Charter. The School shall comp- ly with maximum class size requirements as established in Art. IX, Section 1 of the Florida Con- stitution and Section 1003.03, Florida Statutes. If Section 1003.33(16)(b)3, Florida Statutes, is determined by judicially final and non-appealable decision to be constitutional, then the School may calculate its compliance with class size averaged at the school level, as provided by that sec- tion. The School shall comply with all class size reduction-reporting requirements imposed by the Florida Department of Education on the Sponsor.

Grantee certifies that it has adopted and enforces a Tobacco-Free Workplace Policy that meets or exceeds all of the following minimum standards of: i. Prohibiting the use of all forms of tobacco products, including but not limited to cigarettes, cigars, pipes, water pipes (hookah), bidis, kreteks, electronic cigarettes, smokeless tobacco, snuff and chewing tobacco; ii. Designating the property to which this Policy applies as a "designated area,” which must at least comprise all buildings and structures where activities funded under this Grant Agreement are taking place, as well as Grantee owned, leased, or controlled sidewalks, parking lots, walkways, and attached parking structures immediately adjacent to this designated area; iii. Applying to all employees and visitors in this designated area; and iv. Providing for or referring its employees to tobacco use cessation services. B. If Grantee cannot meet these minimum standards, it must obtain a waiver from the System Agency.
