Obligation to Purchase. While Customer shall be obligated to pay for the Contract Quantity annually regardless of the amount of District Water actually diverted by Customer pursuant to this Agreement, Customer shall not be required to pay for any portion of the Contract Quantity that is not available for diversion as set forth as determined by District in Article 11. At any time, the Customer may refuse to accept District Water pursuant to this Agreement, however, the Customer shall remain obligated to make payment required under this Agreement.
