Obligation to Refrain from Discrimination. 23.1.1 Contractor covenants and agrees that it shall not discriminate, and it shall require all of its Subcontractors not to discriminate, against any Person, or group of Persons, on account of age, sex, race, creed, color, national origin, religion or the presence of any disability, in connection with the Project, nor shall Contractor establish or permit any such practice or practices of discrimination or segregation with reference to the selection, use, hiring, firing, promotion or termination of employees or Subcontractors; provided, however, that the prohibition against discrimination on the basis of disability shall not apply if the particular disability prevents the proper performance of the particular Person involved. 23.1.2 Contractor shall conduct its activities in connection with the Project in compliance with all other requirements imposed pursuant to Title 2.2, Chapter 42, Virginia Code
