Common use of Obligations with Respect to Contracts; Modifications Clause in Contracts

Obligations with Respect to Contracts; Modifications. The Servicer will duly fulfill and comply with, in all material respects, all obligations on the part of the Trust Depositor to be fulfilled or complied with under or in connection with each Contract in the Contracts Pool and will do nothing to impair the rights of the Indenture Trustee and the Holders in, to and under the Trust Assets. The Servicer will perform such obligations under the Contracts in the Contracts Pool and will not change or modify the Contracts, except as otherwise provided herein and except insofar as any such failure to perform, change or modify would not materially and adversely affect the value of (or the rights of the Trust, on behalf of the Holders, or the Indenture Trustee, on behalf of the Noteholders, with respect to) the Contracts or the related Equipment.
