Common use of Offensive or Disparaging Content Clause in Contracts

Offensive or Disparaging Content. Where the Services or any web-based services used in delivering the Services contain offensive content or portray Citizens in a disparaging way, as solely determined by Citizens, Vendor shall immediately remove the offensive or disparaging content. In the case that Vendor fails to immediately remove the offensive or disparaging content, Citizens shall have the right, at Citizens’ sole election, to immediately terminate the Agreement, in whole or in part, and be entitled to a return of any prepaid Services Fees.

Offensive or Disparaging Content. Where the Services or any web-web based services used in delivering providing Services with the Services contain offensive content or portray Citizens in a disparaging way, either as solely determined by Citizens, Vendor shall immediately remove the offensive or disparaging content. In the case that Vendor fails to immediately remove the offensive or disparaging content, content and Citizens shall have the right, at Citizens’ sole election, to to: (a) immediately terminate this Agreement or any Exhibit A corresponding to the Agreement, in whole offending or in part, disparaging content and be entitled to a return of any prepaid Services Feesfees; or, (b) pursue such other remedies permitted by law.
