OMITTED WORK. 62.1. If any Contract Work in a lump sum Contract, or if any part of a lump sum item in a unit price, lump sum, or percentage-bid Contract is omitted by the Commissioner pursuant to Article 64, the Contract price, subject to audit by the EAO, shall be reduced by a pro rata portion of the lump sum bid amount based upon the percent of Work omitted subject to Article 62.
OMITTED WORK. 53.1. If any Contract Work in a lump sum Contract, or if any part of a lump sum item in a unit price, lump sum, or percentage-bid Contract is omitted by the Commissioner pursuant to Article 55, the Contract price, subject to audit by the EAO, shall be reduced by a pro rata portion of the lump sum bid amount based upon the percent of Work omitted subject to Article 53.4.
53.2. If the whole of a lump sum item or units of any other item is so omitted by the Commissioner in a unit price, lump sum, or percentage-bid Contract, then no payment will be made therefor except as provided in Article 53.4.
53.3. For units that have been ordered but are only partially completed, the unit price shall be reduced by a pro rata portion of the unit price bid based upon the percentage of Work omitted subject to Article 53.4.
53.4. In the event the Contractor, with respect to any omitted Work, has purchased any non- cancelable material and/or equipment that is not capable of use except in the performance of this Contract and has been specifically fabricated for the sole purpose of this Contract, but not yet incorporated into the Work, the Contractor shall be paid for such material and/or equipment in accordance with Article 82; provided, however, such payment is contingent upon the Contractor’s delivery of such material and/or equipment in acceptable condition to a location designated by the City.
53.5. The Contractor agrees to make no claim for damages or for loss of overhead and profit with regard to any omitted Work.
OMITTED WORK. The Fund reserves the right at any time during the progress of the work to delete, modify or change the work covered by the Contract, by a Change Order or Field Order thereto providing for either a reduction or omission of any portion of the work, without constituting grounds for any claim by the Contractor for allowances for damages or for loss of anticipated profits and in such event a deduction shall be made from the Contract consideration, the amount of which is to be determined in accordance with the provisions of Section 4.02 or 4.05A of the Agreement.
OMITTED WORK. 31.1 If any Work in a lump-sum subcontract, or if any part of a lump-sum item in a unit price, lump-sum, or percentage-bid subcontract is omitted by the Director pursuant to Article 33, the subcontract price, subject to audit by CUCF, shall be reduced by a pro-rata portion of the lump-sum bid amount based upon the percent of Work omitted, subject to Article 31.
OMITTED WORK. 62.1. If any Contract Work in a lump sum Contract, or if any part of a lump sum item in a unit price, lump sum, or percentage-bid Contract is omitted by the Commissioner pursuant to Article 64, the Contract price, subject to audit by the EAO, shall be reduced by a pro rata portion of the lump sum bid amount based upon the percent of Work omitted subject to Article 62.
4. For the purpose of determining the pro rata portion of the lump sum bid amount, the bid breakdown submitted in accordance with Article 72 shall be considered, but shall not be the determining factor.
OMITTED WORK. ATL may omit from the Work any Contract item. Such omission of Contract items shall not invalidate the Contract any other Contract provision or requirement. Should a Contract item be omitted or otherwise ordered to be non-performed, the Contractor shall be paid pursuant to the terms of this Section for all Work performed toward completion of such item prior to the date of the order to omit such item and the Contract sum shall reflect the decrease, if any.
OMITTED WORK. If Subcontractor omits Work that is included in the Contract Documents, Contractor will have the right to withhold from payments due or to become due in an amount which, in the Contractor’s opinion, is equal to 150% of the value of Work that was omitted until the Work is performed.
OMITTED WORK. For Omitted Work for which a unit price is shown in the Construction Bid Sheet, Company shall be credited for such omitted Work at the applicable unit prices. Units of such omitted Work will be reflected in the semi-monthly estimates provided for in Section 30.1 of Article 30.0
OMITTED WORK. 1. PWCSA may at any time by a written order require the omission of such Contract Work as it may find necessary or desirable in its sole and absolute discretion.
2. An order for omission of Work will be valid only if signed by PWCSA's representative and the Work so ordered must be omitted by the Contractor. The amount by which the Contract Sum will be reduced shall be determined in accordance with the methods set forth in Article 8.B.3.
OMITTED WORK. 11.6.1. The CITY may at any time, by written order, without Notice to the Sureties, require omission of such contract WORK as it may find necessary or desirable. An order for omission of WORK shall be valid only by an executable change order. All WORK so ordered must be omitted by the CONTRACTOR. The amount by which the contract price shall be reduced shall be determined as follows:
11.6.1.1. By such applicable unit prices, or rates for WORK of a similar nature or character as set forth in the contract; or,
11.6.1.2. By the appropriate lump sum price set forth in the Contract; or,
11.6.1.3. By the reasonable and fair estimated cost of such omitted WORK and profit percentage as determined by the CONTRACTOR and the CONSULTANT, and approved by the CITY.
