Common use of On-Call Duty Clause in Contracts

On-Call Duty. (i) If a Casual Employee is not working but the Employee is required by the Employer to be readily available to respond without undue delay to any request to report to work, the Employee shall be paid three dollars ($3.00) for each assigned hour of authorized on-call duty. (ii) On Named Holidays they shall be paid four dollars and twenty five cents ($4.25) per hour. A Named Holiday shall run from zero zero zero one (0001) hours on the Named Holiday to twenty-four hundred (2400) hours of the same day. (iii) A Casual Employee who is called back to work and required to report for work without undue delay during the on-call period shall not be paid the on-call rate during the period they are working but will be paid for the hours worked during the on-call period at either: (a) the overtime rate of two times (2X) the Basic Rate of Pay; or (b) four (4) hours at the Basic Rate of Pay; whichever is greater. (iv) When employees are supplied a pocket pager by the Employer for the purpose of On-Call Duty, there shall be no cost to the Employee for the use of the pocket pager. (v) A Casual Employee who was not on call and is employed in a regularly scheduled full-time or part-time capacity and who is called back and required to report for work outside of their scheduled hours shall be paid for any one (1) call at either: (a) the overtime rate of two times (2X) the Basic Rate of Pay; or (b) four (4) hours at the Basic Rate of Pay; whichever is greater.
