Operating and Maintenance Expenses. Subject to the provisions herein addressing the use of facilities by others, and except for operations and maintenance expenses associated with modifications made for providing interconnection or transmission service to a third party and such third party pays for such expenses, Developer shall be responsible for all reasonable expenses including overheads, associated with: (1) owning, operating, maintaining, repairing, and replacing Developer Attachment Facilities; and (2) operation, maintenance, repair and replacement of Connecting Transmission Owner’s Attachment Facilities. The Connecting Transmission Owner shall be entitled to the recovery of incremental operating and maintenance expenses that it incurs associated with System Upgrade Facilities and System Deliverability Upgrades if and to the extent provided for under Attachment S to the NYISO OATT.

(1) owning, operating, maintaining, repairing, and replacing Interconnection Customer’s Interconnection Facilities; and (2) operation, maintenance, repair and replacement of Transmission Owner’s Interconnection Facilities to the extent required by Transmission Owner on a comparable basis.

The Connecting Transmission Owner shall be responsible for all reasonable expenses including overheads, associated with owning, operating, maintaining, repairing, and replacing the Network Upgrade Facilities.

The Connecting Transmission Owner shall be entitled to the recovery of incremental operating and maintenance expenses that it incurs associated with System Upgrade Facilities and System Deliverability Upgrades if and to the extent provided for under Attachment S to the NYISO OATT.
Operating and Maintenance Expenses. Subject to the provisions herein addressing the use of facilities by others, and except for operations and maintenance expenses associated with modifications made for providing interconnection or transmission service to a third party and such third party pays for such expenses, TrAILCo shall be responsible for all reasonable expenses including overheads, associated with: owning, operating, maintaining, repairing, and replacing its System Upgrade Facilities. NYSEG shall be entitled to the recovery of incremental operating and maintenance expenses that it incurs associated with System Upgrade Facilities, if and to the extent provided for under Attachment S to the NYISO OATT.

The Connecting Transmission Owner shall be entitled to the recovery of incremental operating and maintenanceresponsible for all reasonable expenses that it incursincluding overheads, associated with Systemowning, operating, maintaining, repairing, and replacing the Network Upgrade Facilities and System Deliverability Upgrades if and to the extent provided for under Attachment S to the ISO OATT.
Operating and Maintenance Expenses. The Interconnection Customer shall be responsible for the Operating and Maintenance (“O&M”) expenses associated with the Connecting Transmission Owner Interconnection Facilities listed at Section D of this Attachment. Interconnection Customer shall pay to Connecting Transmission Owner for O&M expenses each month during the term of this Agreement an amount equal to 1/12 of the product of 9% and the actual total cost of such Connecting Transmission Owner Interconnection Facilities. Estimated Monthly O&M calculation = 1/12 x 0.09 x $41,332 (to be adjusted by final actual costs) Estimated Monthly O&M payment = $309.99 All O&M payments due to be made by the Interconnection Customer under this Agreement shall be made within thirty (30) calendar days after receiving an invoice from the Connecting Transmission Owner.
