Operating Regulations a. Scooters are not to be operated on public sidewalks. Scooters are to be ridden on streets, and where available, in bike lanes and bike and multiuse paths. Scooters are to stay to the right of street travel lanes and to yield the right of way to bicycles in bike lanes and on bike or multiuse paths. City reserves the right upon five (5) business day’s written notice to Company to limit the use of Scooters in designated areas due to public safety or traffic concerns. Additionally, Company agrees following written notification from the City to Geofence Scooters from operating in any geographic area designated by the City in which the use of such Scooters is prohibited due to public safety or traffic concerns.
b. Company shall provide easily visible contact information, including toll-free phone number and/or e-mail address on each Scooter for City employees and/or members of the public to make relocation requests or to report other issues with devices.
c. Company shall begin operations with a fleet size of at least 100 but not more than 500 Scooters. Following a written request to the City, Company may be permitted to increase its fleet size in the event that Company’s fleet provides on average more than three rides per Scooter per day and that Company has satisfactorily complied with the terms of this Agreement. City may require Company to reduce its fleet size on a monthly basis in the event Company’s fleet provides on average less than one-half ride per Scooter per day. Company will provide data as specified in Section 10 to City to determine and demonstrate the utilization rate of vehicles in Company’s fleet.
Operating Regulations a. Company, and/or its service providers, agents or assigns, shall be responsible for operating a Stand-up Electric Scooter program in the City with the below requirements.
Operating Regulations. 1. Not later than January 1, 1995, the Parties shall agree on rules of operation for CIRI.
2. The regulations shall include the rules of operation of the CIRI and the conditions regarding delivery times, quantity, quality and prices of the materials referred to in paragraph 3 of article 6-21.
Operating Regulations. Manager acknowledges that as a “permitted Agent” of Xxxxxx Bank, the terms of the Network Rules governing an issuer’s relationship with the applicable Network also govern Manager’s relationship with the applicable Network, to the extent applicable, including, for: cardholder obligations, responsibility for fraud, collections and other risks, data security, indemnity and liability, and confidentiality. Manager represents that it has read, agreed and will comply with all terms of the applicable Network Rules, including the foregoing specifically identified provisions as such are provided to Manager by Xxxxxx Bank.
Operating Regulations. 5.1. Bird shall provide easily visible contact information for Bird’s locally based operations manager, including toll-free phone number and e-mail address on each electric scooter for members of the public to make relocation requests or to report other issues with devices. 5.2. Safety requirements.
Operating Regulations. You agree to comply with the Requirements of Law, Rules, and Association Rules which in regard to the Mastercard RPPS shall also include Mastercard RPPS rules, manuals and other published policies such as the RPPS API Specifications or Mastercard RPPS User Guide and Operating Rules in effect from time to time (“Mastercard RPPS Documentation”). The Rules or Association Rules in regard to Mastercard RPPS specifically include, but are not limited to, complying with any audit and compliance policies and procedures pertaining to the Mastercard RPPS, as provided by the Bank from time to time. You agree you shall only use the Mastercard RPPS to transmit payments wholly within the United States and shall maintain records reflecting the transaction(s) giving rise to each payment for a reasonable period of time but in no event less than two (2) years to assist in resolving any end user disputes that may arise in connection with the Mastercard RPPS. You covenant to keep yourself continuously informed of changes in the Rules and Association Rules. In the event that you are required to sign any separate agreement or complete any registration in connection with our sponsorship, you agree to fulfill all obligations imposed on it under such agreement and/or in connection with such registration (it being understood that you will have the opportunity to review and request revisions to the terms of such agreements, although the Bank cannot guarantee that Mastercard will accept your revisions).
Operating Regulations. The Operating Regulations may be changed by Bank from time to time upon not less than sixty (60) days prior written notice to Company, provided, however, that changes which do not require major systems or operational modifications and changes required for security measures shall become effective as soon as possible following Company's receipt of notice thereof but in all events shall become effective within ten (10) days of Company's receipt of notice thereof. In the event of any conflict or inconsistency between the terms of this Agreement and those of the Operating Regulations, the former shall govern.
Operating Regulations. The “Operating Regulations” attached as Annex 1 are an integral part of this Agreement.
Operating Regulations. Lessee warrants that the Equipment will be installed, used and operated and otherwise be in compliance with (a) any established operating procedures therefore of the manufacturer, and (b) all statutes, regulations and orders of any governmental body having power to regulate the Equipment or its use. Lessee agrees that adherence to such installation, use, operation and compliance will be the sole obligation of the Lessee. Lessee will obtain such licensing and registration of the Equipment as required by Federal, state or local law or regulation. Any costs of compliance, licensing and registration will be borne by Lessee. Lessee further warrants that the Equipment will be operated only by qualified personnel who are covered by professional liability insurance in amounts and against risks customarily insured against in the medical field.
Operating Regulations a. Company acknowledges, understands and concurs with the following interim regulations for operating electric foot scooters. “Electric foot scooter” shall mean a device weighing less than 100 pounds, with two or three wheels, handlebars and a floorboard that can be stood upon while riding, and is solely powered by an electric motor and/or human power that is capable of propelling the device with or without human propulsion on a paved level surface.
b. Electric foot scooters are not to be ridden on sidewalks. Electric foot scooters are to be ridden on streets, and where available, in bike lanes and bike paths. Electric foot scooters are to stay to the right of street lanes and to offer the right of way to bicycles in bike lanes and on bike paths.
c. Company shall provide easily visible contact information, including a twenty-four (24) hour toll-free phone number and/or e-mail address on each electric foot scooter for members of the public to make relocation requests or to report other issues with devices.
d. Company shall also provide City with contact information of a locally-based manager/operation staff with decision making power who can respond to City requests, emergencies, and other issues twenty-four (24) hours a day seven (7) days per week.
e. Company shall not operate within the city limits of the City of Decatur at any given time more than a total of seventy-five (75) electric foot scooters (“Fleet”). Within the total Fleet allotment, the Company can deploy up to fifty (50) electric foot scooters within a one-mile radius of One West Court Square. City may request data from Company on a weekly basis to determine and demonstrate the utilization rate of devices in Company’s fleet within the city limits of the City of Decatur. Company may increase or decrease the Fleet size only with the City’s written approval if usage data demonstrates an average use of two rides per scooter per day. The City may deny a request to increase the Fleet size at its sole discretion.
f. In addition to any taxes and fees imposed by City’s Code of Ordinances to operate a business, Company shall remit a regulatory fee of $4,000 annually. Such fees shall be remitted within thirty (30) days of the Effective Date.
g. Company shall ensure that the head-lights and tail-lights are operational every morning to improve safe ridership.
