Operation and Maintenance Expenses. This category consists of the cost of labor, materials and supplies, and other expenses incurred in operating and maintaining Hetch Hetchy Enterprise physical facilities.
Operation and Maintenance Expenses. 22.1 The expenses for the operation and maintenance of the San Xxxx Project in the performance of Operating Work (which, for purposes of this Section 22, and as defined more particularly herein, are referred to as the “O&M Expenses”) shall be apportioned among the Participants, in accordance with the following percentages:
Operation and Maintenance Expenses. In accordance with Section 10.5 of this Agreement, Developer shall be responsible for all reasonable operation and maintenance expenses (“O&M Expenses”) associated with the operation, maintenance, repair and replacement of Connecting Transmission Owner’s Attachment Facilities, as such Attachment Facilities are detailed in this Appendix A. In addition, Developer shall also be responsible for the incremental costs that are incurred by the Connecting Transmission Owners pursuant to Section 10.6 of this Agreement to assure compliance with the NRC Maintenance Rule. The Scriba Substation facilities covered by the NRC Maintenance Rule are listed in Section 5 of Appendix C of this Agreement. Developer shall have the option to pay the O&M Expenses for which it is responsible under Section 10.5 of this Agreement by following either the procedure described in Option 1 or the procedure described in Option 2 below.

Operation and Maintenance Expenses a fixed monthly rate for operation and maintenance expenses and other miscellaneous costs and expenses incidental to the operation, protection, and maintenance of the Interests and Property (but excluding costs under paragraph (b) below) based on the average operation, maintenance, and miscellaneous costs and expenses for each Interest for the three-month period before the Effective Time.
Operation and Maintenance Expenses. The Operation and Maintenance Expenses of the Project in any month shall not exceed the lesser of (i) actual expenses Credit Agreement incurred and (ii) the expenses set forth in the Operating Budget for such month subject to the Permitted Operating Budget Deviation Levels.
Operation and Maintenance Expenses and (3) Budgeted CRR costs (together the “Cost Compilation”) and (ii) the total actual amount of funds received from the WCID during the same Fiscal Year from those components of the Annual Requirement related to the Debt Service Requirement, Operation and Maintenance Requirement and the Budgeted Capital Repair and Replacement Requirement (together the “Receipts Compilation”). Contemporaneously with the compilation and delivery of these respective Compilations, GBRA shall deliver a comparison of the Cost Compilation to the Receipts Compilation (the “True Up”). If the total of the Cost Compilation exceeds the total of the Receipts Compilation in the True Up, GBRA shall xxxx the WCID the difference within thirty (30) days of such determination and WCID shall remit payment of such xxxx within thirty (30) days of xxxx receipt. If the total of the Cost Compilation is less than the total of the Receipts Compilation in the True Up, GBRA shall reimburse the WCID the difference within thirty (30) days of such determination. Contemporaneously with the delivery of the True Up, GBRA shall also compile and deliver the outstanding GBRA DS Payment and GBRA CRR Payment balances, including interest thereon. The WCID shall have the option at any time of paying some or all of such outstanding balances that are not otherwise paid pursuant to Section 6.1(iv) and (v), the result of which would be a reduction in the ultimate amount of interest accrued on said balances. Following the delivery of the True Up, the parties will work in good faith to resolve any difference they may have with respect to any matter set forth in the True Up.
Operation and Maintenance Expenses. (1) The O&M expenses for the first year of the Control Period will be approved by the Commission taking into account the actual O&M expenses for last five years till Base Year subject to prudence check and any other factors considered appropriate by the Commission.
Operation and Maintenance Expenses. 10.1 The expenses incurred by the Operating Agent for the operation and maintenance of SONGS Unit 1, SONGS Units 2 and 3, and the SONGS Common Facilities chargeable to FERC Accounts 517, 518 (excluding costs shared pursuant to Section 11), 519 through 525, inclusive, 528 through 532, inclusive, 560, 562, 566, 568, 569, 570, 573, and other accounts, as appropriate and agreed to by the Fiscal Representatives, shall be shared by the Parties, (other than Anaheim, whose rights and duties under this Section 10 shall be determined by the terms and conditions of the Settlement Agreement, notwithstanding any contrary language in this Agreement), in proportion to their respective Ownership Shares in the facility or land area for which such expenses are incurred, except for Common Costs for SONGS Units 2 and 3. For example, accounts 556 and 561 shall be included to the extent that such costs are justifiable subsequent to the execution of this Agreement. Common Costs for SONGS Units 2 and 3 will be shared in the following percentages effective until SONGS Units 2 and 3 permanently close: Party Percentage Edison 78.21% SDG&E 20.00% Anaheim 0.00% Riverside 1.79% After SONGS Units 2 and 3 permanently close, Common Costs shall be shared by the Parties in proportion to their respective percentage share obligations to pay for decommissioning costs of each unit.
