Order of Interpretation. In the event of any inconsistencies between the terms and conditions of the body of this Agreement and the Schedules, the provision of the body of this Agreement shall prevail over the terms of any Schedule.
Order of Interpretation. If there is any inconsistency between the documents forming part of or contemplated by the entire agreement between the parties, then the provisions should be read in order of the following priority and interpreted as follows:
Order of Interpretation. If this contract conflicts with other documents, the conflict will be resolved in the following order: this contract and signed amendments, the DHS procurement, the attachments to this contract.
Order of Interpretation. Each Schedule is automatically deemed to include all the terms and conditions of the Subscription Agreement and these Terms; provided that whenever the provisions of a Schedule expressly conflict with the Subscription Agreement or these Terms, the agreements should be interpreted in the following order: (a) the conflicting provisions of the Schedule control and take precedence over the conflicting provisions of the Subscription Agreement and these Terms, then (b) the conflicting provisions of the Subscription Agreement shall take precedence over the conflicting provisions of these Terms.
Order of Interpretation. To the greatest extent possible, the main body of this Agreement and each of its attached Schedules shall be construed consistently, so as to complement each other. All rights, responsibilities and remedies established in such documents are cumulative. Any conflict or inconsistency between any provision of the main body of this Agreement and any provision of any of its Schedules shall be resolved by giving priority to such documents in the following descending order: (i) the main body of this Agreement, not including its Schedules; (ii) Schedule 10 (Governing Law and Dispute Resolution Process); (iii) the Bailment Agreement (if the Parties entered into a Bailment Agreement); (iv) the Joint Development Terms and Conditions; (v) the Social Compliance Requirements; (vi) the Procedures Manual; (vii) the Confidentiality Agreement; (viii) the Product Specifications; and (ix) the content of all other Schedules to the Agreement.
Order of Interpretation. 18.1 In the case of conflict between or among documents related to this Agreement, the following order of precedent shall apply: (i) first Articles 1.0 through 20.2 of this Agreement, (ii) Task Order(s) issued against this Agreement, then (iii) Exhibits, if any, to this Agreement.
Order of Interpretation. 1. The Contract will be awarded to the responsible proposer whose proposal conforms to the RFP, and is the most advantageous to the state, price and other factors taken into consideration.
Order of Interpretation. 17.1 If the Agreement document and its appendices contradict each other, the Agreement document shall apply primarily, followed by the appendices in numerical order.
Order of Interpretation. 19.1.1 If this Agreement and the Share Pledge Agreement are in conflict, the Share Pledge Agreement shall prevail. If this Agreement and the Share Purchase Agreement or the STA are in conflict, this Agreement shall prevail. In a case of conflict between this Agreement and the Articles or this Agreement and the Companies Act, this Agreement shall prevail between the Parties.
Order of Interpretation. Each Schedule is automatically deemed to include all the terms and conditions of the Poof Dispensary Agreement and these Terms; provided that whenever the provisions of a Schedule expressly conflict with the Poof Dispensary Agreement or these Terms, the agreements should be interpreted in the following order: (a) the conflicting provisions of the Schedule (except for Schedule B – Service Level Agreement) control and take precedence over the conflicting provisions of the Poof Dispensary Agreement and these Terms, then (b) the conflicting provisions of the Poof Dispensary Agreement shall take precedence over the conflicting provisions of these Terms. For clarity, the provisions of the Poof Dispensary Agreement shall take precedence over the provisions of Schedule B – Service Level Agreement.
