If the SI presents a Recoverable Submission after the Submission Date or in violation of the Orderly Submission Requirement, then the SI shall be deemed to have waived the Initial Applicable Review Period, and no Excusable Delay Extension shall be available with respect to the non-compliant Recoverable Submission, irrespective of when the MTA completes its Review and Approval process.
