Common use of Other Debt Clause in Contracts

Other Debt. Except as provided herein, the SPV shall not create, incur, assume or suffer to exist any indebtedness whether current or funded, or any other liability other than (i) indebtedness of the SPV representing fees, expenses and indemnities arising hereunder or under the First Tier Agreement for the purchase price of the Receivables and other Affected Assets under the First Tier Agreement, and (ii) other indebtedness incurred in the ordinary course of its business in an amount not to exceed $9,500 at any time outstanding.

Other Debt. Except as provided herein, the SPV shall not create, incur, assume or suffer to exist any indebtedness whether current or funded, or any other liability other than (i) indebtedness of the SPV representing fees, expenses and indemnities arising hereunder or under the First Second Tier Agreement for the purchase price of the Receivables and other Affected Assets under the First Second Tier Agreement, and (ii) other indebtedness incurred in accordance with the ordinary course of its business in an amount not to exceed $9,500 at any time outstandingTransaction Documents.
