If ITUNES at any time during the Term exercises its discretion under Section 3(b) to accept additional product configurations, then ITUNES will make available one or more wholesale price tiers for such additional products. In the event that any Product is incorporated or installed in, or combined with, another product, material, component or part ("Other Product"): (i) Seller shall have no risk, liability, obligation or responsibility of any kind with respect to such Other Product, and (ii) Buyer shall be solely liable, obligated and responsible for all Other Products in which it may incorporate or install, have a third party incorporate or install, or authorize a third party to incorporate or install any Products and/or with which it may combine, have a third party combine, or authorize a third party to combine any Products.

The Parties agree that LICENSEE is not limited to production of the End Products defined herein, but that LICENSEE may develop, create and test new products that are derived from or otherwise incorporate the Technology and such new products are only to be distributed and/or sold to Permitted Locations (the “New Products”), subject to availability of licenses in the future from Lexaria.
