Overcycle. When an employee exceeds their swing length by three days (counting from and including the nominated swing day) the overcycle payment shall apply for each day in excess of the swing period. The over cycle penalty shall be calculated on 100% of the employee’s current rate of pay. The over cycle penalty does not apply to any additional leave accrued during the over cycle period. The over cycle penalty does not apply to any over cycle period due to an employee paying off on compassionate leave. No seafarer on leave or off duty shall be disadvantaged by an opposite swing employee receiving overcycle payments. For clarity an off-swing employee denied the opportunity to return to their usual swing shall continue to accrue leave during that period they would otherwise have worked.

Overcycle. When an employee is required to return to the facility earlier than required by the roster, or the employee is required to remain on the facility at the conclusion of the employee’s on duty roster period, the employee will be paid an additional 2.5 days pay for up to 5 additional days duty and thereafter an additional 4 days pay for each subsequent day of duty. When an employee is recalled to work during the employee’s off duty period and the employee returns home prior to commencing their normal rostered duty, the employee will be paid overcycle payment for the days worked and for the days spent travelling to and from the facility. Provided that these provisions do not apply where such work is by mutual arrangement (approved by the OIM) between employees, or where crew change is not possible due to the facility being off the riser due to weather conditions.
Overcycle. ‌ (a) Where an Employee is required by Diamond Offshore to remain On-duty in excess of 28 days or required to return to the rig early when they are Off-duty in circumstances where they have not had equal time off duty as On-duty in the last work period, the Employee will receive a 50% loading per hour calculated on the Employee's Hourly Rate of Pay in addition to the Employee's Salary. (b) For the avoidance of doubt, the overcycle loading under this clause 8.4 is not payable in the following circumstances: (i) where an Employee is required to change crews or change days as a result of a promotion; or (ii) when an Employee (Employee 1) requests for a fellow Employee (Employee 2) to cover a proposed period of absence through a mutual swap, should Employee 2 agree to cover the requested time off and the mutual swap is approved, the overcycle loading will not apply to any additional time worked in this instance. This clause applies to the additional periods worked by both Employee 1 and 2.
Overcycle. Employees required to work overcycle will receive payment for overcycle shifts as follows: Operator Grade 1 $412.02 - $556.16 Operator Grade 2 $556.16 - $675.34 Operator Grade 3 $675.34 - $794.51 The rates contained in this table represent a 5.5% increase on previous overcycle rates. This 5.5% increase will be paid from the date of lodgement of this Agreement. The overcycle rates will be increased by a further 5% twelve months after the date of lodgement of this Agreement. Overcycle will be paid in the month it is worked. In the event that less than a complete shift is required to be worked, the hourly rate shall be calculated by dividing the appropriate 12 hour shift rate by 12. A minimum of four hours will be paid for any one call-in. No employee shall unreasonably refuse to work overcycle or be available for a call-in and will not be disadvantaged for the following days work period.

Overcycle. Employees may be required to work more than the Rostered Work Hours or Rostered Workdays offshore, in which case the Overcycle Flat Hourly Rate of Pay, as outlined in the table below, shall apply. The Overcycle Flat Hourly Rate of Pay are inclusive of all items listed in Clause 3.2 above. This clause will apply to: a) Work done on the demobilisation Travel Day which is within the On-Duty Period and which is a consequence of the Work Cycle travel arrangements. b) Training conducted in the Off-Duty Period.
Overcycle. 5.5.1 Overcycle will apply where an Employee is required and agrees to work beyond his/her span of rostered on duty days to cover operational requirements. 5.5.2 An Employee may be required to be available for Overcycle in order to meet operational requirements. This requirement may ordinarily (but not exclusively) include coverage for planned shut downs, projects, training and leave. 5.5.3 Payment for Overcycle will be made at the rate of double time. 5.5.4 Overcycle Stand-By: Process Operators – Moomba. 5.5.3.1 A payment equal to four (4) hours ordinary pay as Overcycle Stand-By will be made to two (2) Employees per cycle on Overcycle Stand-By, provided that the group of Employees concerned take the responsibility for providing the cover and advising management in advance of the names of the individuals on call on each occasion. 5.5.3.2 Four (4) hours travel time will be paid to any individual required to fly back to Moomba and to return to Adelaide in order to work Overcycle under this arrangement. 5.5.3.3 This provision will apply in addition to the payment of the stand-by allowance at the rate of two (2) hours extra, at single time for each day an Employee is kept back in the field.

  • Random Testing Notwithstanding any provisions of the Collective Agreement or any special agreements appended thereto, section 4.6 of the Canadian Model will not be applied by agreement. If applied to a worker dispatched by the Union, it will be applied or deemed to be applied unilaterally by the Employer. The Union retains the right to grieve the legality of any imposition of random testing in accordance with the Grievance Procedure set out in this Collective Agreement.

  • Outcomes Secondary: Career pathway students will: have career goals designated on SEOP, earn concurrent college credit while in high school, achieve a state competency certificate and while completing high school graduation requirements.

  • ODUF Testing 6.6.1 Upon request from TWTC, AT&T shall send ODUF test files to TWTC. The Parties agree to review and discuss the ODUF file content and/or format. For testing of usage results, AT&T shall request that TWTC set up a production (live) file. The live test may consist of TWTC’s employees making test calls for the types of services TWTC requests on ODUF. These test calls are logged by TWTC, and the logs are provided to AT&T. These logs will be used to verify the files. Testing will be completed within thirty (30) days from the date on which the initial test file was sent.

  • CONTRACT VALUE The current total Not-To-Exceed (NTE) value of this contract is: 2.3.1.1 The Contractor exceeds the NTE amount at his/her own risk. The Contractor is under no obligation to provide additional services that would cause the Contractor’s fees to exceed the NTE amount without prior revision of this amount by written change order. Further, the Agency reserves the right to amend this amount (increase/decrease) at any time during the ensuing contract period(s) when the Agency determines doing so is in its best interests.

  • PRODUCTIVITY The Union shall place no limitations upon the amount of work which an Employee shall perform during the working day and there shall be no restrictions imposed against the use of any type of machinery, tools or labour saving devices.

  • Outputs Analogue and digital outputs of protected content are allowed if they meet the requirements in this section and if they are not forbidden elsewhere in this Agreement..

  • Distribution Upgrades The Connecting Transmission Owner shall design, procure, construct, install, and own the Distribution Upgrades described in Attachment 6 of this Agreement. If the Connecting Transmission Owner and the Interconnection Customer agree, the Interconnection Customer may construct Distribution Upgrades. The actual cost of the Distribution Upgrades, including overheads, shall be directly assigned to the Interconnection Customer. The Interconnection Customer shall be responsible for its share of all reasonable expenses, including overheads, associated with owning, operating, maintaining, repairing, and replacing the Distribution Upgrades, as set forth in Attachment 6 to this Agreement.

  • Calibration The comparison of a measurement system or device of unverified accuracy with a measurement system of known and greater accuracy to detect deviation of the unverified measurement system from required performance specifications (of the unverified measurement system or device) and to quantify all measured values to applicable units of the international system of units.

  • Random Drug Testing All employees covered by this Agreement shall be subject to random drug testing in accordance with Appendix D.

  • Product Testing No later than [**] prior to a scheduled Delivery ARIAD US shall send to ARIAD SWISSCO the Delivery Documents for review. Following such review, unless within [**] of receipt of the Delivery Documents ARIAD SWISSCO gives written notice of rejection of the Product to be delivered, stating the reasons for such rejection, the Delivery shall proceed, and both Parties shall organize the same. Upon arrival at ARIAD SWISSCO nominated site it shall visually inspect the shipment of the Product to identify any damage to the external packaging. ARIAD SWISSCO may reject any shipment (or portion thereof) of the Product that is damaged by providing to ARIAD US reasonable evidence of damage within [**] after Delivery of such Product. If ARIAD SWISSCO does not so reject any shipment (or portion thereof) of the Product within [**] of Delivery of such Product, ARIAD SWISSCO shall be deemed to have accepted such shipment of the Product; provided, however, that in the case of the Product having any Latent Defect, ARIAD SWISSCO shall notify ARIAD US promptly once it becomes aware that a Product contains a Latent Defect and subsequently may reject such Product by giving written notice to ARIAD US of ARIAD SWISSCO’s rejection of such Product and shipping a representative sample of such Product or other evidence of Non-Conformance to ARIAD US within [**] after becoming aware of such Latent Defect, which notice shall include a description of the Latent Defect.
