Overdue Rent. The Tenant covenants to pay the Basic Rent, Additional Rent and all other charges provided for in this Lease on their respective due dates in full. The Tenant shall pay the Landlord interest on all overdue Rent, all such interest to be calculated from the date upon which the amount is first due hereunder until actual payment thereof and at a rate [Intentionally Deleted] equal to the minimum lending rate charged to prime commercial borrowers by the Landlord’s bank from time to time.
Overdue Rent. Lessee shall pay to Lessor an Overdue Rent Charge of 5% of all Basic Rent payments not received by Lessor on or before the Basic Rent Payment Date.
Overdue Rent. Lessee hereby acknowledges that late payment by Lessee to Lessor of rent and other sums due hereunder will cause Lessor to incur costs not contemplated by this Lease, the exact amount of which will be extremely difficult to ascertain. Such costs include, but are not limited to, processing and accounting charges, and late charges which may be imposed on Lessor by the term of any mortgage or trust deed covering the Premises. Accordingly, if any installment of rent or any other sum due from Lessee shall not be received by Lessor or Lessor's designee within ten (10) days after such amount shall be due, then, without any requirement for notice to Lessee, Lessee shall pay to Lessor a late charge equal to six percent (6%) of such overdue amount. The parties hereby agree that such late charge represents a fair and reasonable estimate of the costs Lessor will incur by reason of late payment by Lessee. Acceptance of such late charge by Lessor shall in no event constitute a waiver of Lessee's default with respect to such overdue amount, nor prevent Lessor from exercising any of the other rights and remedies granted hereunder. In the event that a late charge is payable hereunder, whether or not collected, for three (3) consecutive installments of rent, then rent shall automatically become due and payable quarterly in advance, rather than monthly, notwithstanding any other provision of this Lease to the contrary.
Overdue Rent. If the Tenant defaults in the payment of Rent, the unpaid Rent bears interest from the due date to the date of payment in full at the Stipulated Rate in force on the due date. Such interest is not payable until the Landlord demands payment of it.
Overdue Rent. Should any late fee accrue or the rent or any part thereof become overdue, and Home Owner or Landlord sues for same, or sues for possession for non-payment of rent, or any provision that violates the lease agreement, the Tenant shall pay all court costs and all attorney's fees in addition to any other expenses due hereunder. All xxxxx additional fees and expenses of collecting rent shall be deemed additional rent due under this Lease Agreement.
Overdue Rent. If the Tenant defaults in the payment of Rent, the unpaid Rent bears interest from the due date to the date of complete payment, whether before or after default judgment and notwithstanding any provision of law to the contrary, including without restriction, Article 1883 of the Civil Code of Quebec, at the Stipulated Rate in force on the date the payment was due. In addition to the foregoing, the Landlord shall be entitled to any further amounts and damages that it shall justify.
Overdue Rent. Sublessee’s failure to pay rent within 30 days after the due date shall be a default of the Sublease, and Sublessor HCA may then pursue remedies as provided in Section 33, Remedies for Default. Rent payments received after 30 days following the due date shall include the late penalty and interest charges.
Overdue Rent. 9.2.1. Lessee’s failure to pay rent within 30 days after the due date shall be a default of the Lease, and DSHS may then pursue remedies as provided in Section 30, Remedies for Default. Rent payments received after 30 days following the due date shall include the late penalty and interest charges.
9.2.2. Lessee shall pay DSHS a late charge of six percent (6%) of the amount of any rent payment received by DSHS more than 30 days after the due date.
9.2.3. Lessee shall pay DSHS interest at the rate of one percent (1%) per month, beginning on the date such rent is due and until the rent is paid, for any rent payment received by DSHS more than 30 days after the due date.
Overdue Rent. Any Rent lost in the mail or any Rent paid with bad, cancelled, or returned checks will be treated as unpaid until received by Landlord. Xxxxxx further agrees to pay a late charge to Landlord equal to 10% of the amount of monthly Base Rent (the “Late Fee”) if Tenant fails to deliver the monthly Rent to Landlord on or before 5:00 p.m. the 5th day of each month for any reason whatsoever. In addition to the Late Fee, any Rent unpaid on or before 5:00 p.m. the 5th day of each month shall bear interest at the rate of 10% per annum from the date Rent was due until paid in full.
Overdue Rent. The Tenant shall pay the Landlord interest on all overdue Rent not paid on the day appointed for payment thereof or within any applicable notice period pursuant to Section 10.01(a) of this Lease, if any, all such interest to be calculated from the date upon which the amount is first due hereunder or from the expiry of any applicable notice period, if the Tenant is entitled to a notice period pursuant to Section 10.01(a), until actual payment thereof and at a rate being the lesser of three percent (3%) per annum in excess of the minimum lending rate charged to prime commercial borrowers by the Landlord's bank from time to time or the rate permitted by law (the "Lease Interest Rate"). However, in the event the Tenant is late in the payment of Rent two or more times in any twelve (12) consecutive month period then the foregoing interest shall be calculated at the aforementioned rate on all overdue Rent calculated from the date upon which such amount is first due hereunder until actual payment thereof.
