Owner's Engineer. The Owner shall retain a Professional Engineer, or firm of Professional Engineers, registered by and in good standing with the Professional Engineers of Ontario (possessing a current Certificate of Authorization issued by the said Association) and hereinafter called the "Owner's Engineer", for the purposes as set out in Schedule "H" hereto and for the other purposes required by this Agreement. The Owner agrees to continue to retain the services of a Professional Engineer until the Works and Utilities provided for in this Agreement have been completed and accepted by the Municipality.
Owner's Engineer. The Company will appoint an owner's engineer to exercise supervision and management over the construction of the Power Plant.
Owner's Engineer. Developer hereby acknowledges and ---------------- agrees that Owner has employed, and shall continue to employ the Owner's Engineer, all costs of which (not to exceed $1,000.00 per month), shall be paid by Developer out of the Approved Budget, to assist Owner in connection with Owner's review and approval of all plans, specifications, contracts, budgets and related matters, and to regularly inspect the progress of the Project and approve all Disbursement Requests.

Owner's Engineer. The Recipient shall, not later than six (6) months, or any later agreed upon date, after the Effective Date, to hire the Owner's Engineer in accordance with terms of reference and qualifications acceptable to the Association.
Owner's Engineer. Owner’s Engineer shall act on Owner’s behalf, in relation to various Project-related matters, including the review of contract documents, attending design and progress meeting, carrying out inspections and the review and approval of test results and most particularly all Performance Test results.

Owner's Engineer. 6.2.1 The Contracting Entity shall notify the Supplier of the identity and contact details of the Contracting Entity's engineer (the "Owner's Engineer") appointed by the Contracting Entity to manage this Contract on behalf of the Contracting Entity in accordance with the terms of a services agreement entered into between the Owner's Engineer and the Contracting Entity (as may be amended from time to time). The Supplier shall allow the Owner's Engineer such access (including to facilities, sites, personnel and information) as is necessary to enable the Owner's Engineer to satisfy its service obligations and fulfil its contract management functions, (subject to clause 6.2.2) as a representative of the Contracting Entity.
6.2.2 The Contracting Entity shall notify the Supplier in writing (from time to time) of the scope of the Owner's Engineer's authority to act on behalf of the Contracting Entity (and to bind the Contracting Entity) under this Contract (if any), including in respect of the giving of any instruction or other notice to the Supplier, or the receipt of any notice or other communication from the Supplier, under this Contract.
6.2.3 The Contracting Entity shall notify the Supplier in writing of any change of the Owner's Engineer or his contact details.
Owner's Engineer. The Owner shall employ, at the Owner’s expense, a Consulting Engineer registered with Professional Engineers Ontario to design the works and services, oversee the installation of the works and services and to attend to all matters and things required by this agreement as a prerequisite for the assumption of the services. The Engineer’s responsibilities shall include but not be limited to the:
a) Preparation and submission of servicing drawings to the Town (and all other authorities having jurisdiction);
b) Preparation and submission of private drainage connection sheets (“PDC sheets”) to the Town;
c) Preparation of contracts necessary for the construction of the Services;
d) Provision of full-time inspection services;
e) Taking of preconstruction photos as well as photos (as required) during the course of construction of the Services. These photographs shall be available for inspection by the Town until the end of the maintenance period and final assumption of the Services by the Town;
f) Confirmation of the competency of the subsurface soil conditions for the Roadway by means of a Geotechnical sub-consultant; and
g) Preparation of and submission of "as-built" drawings to the Town (and all other authorities having jurisdiction).
Owner's Engineer. The Owner covenants and agrees to retain a consulting Professional Engineer (the "Engineer"), skilled and experienced in municipal work, to design, supervise, layout, inspect and maintain the Works and remedy any defects, and to be responsible to the Township for the design, supervision, layout, inspection, maintenance and remedies until the time of final acceptance of the Works by the Township, as applicable. The Owner's engineer shall duly discharge all of the Duties set out in Schedule 'C'.
