Ownership By XxxXxxxx. Customer shall have no rights with respect to any AnyChart Mark. Any and all goodwill arising from Customers’ use of the AnyChart Marks shall inure solely to the benefit of AnyChart. Customer shall not assert any claim to the AnyChart Marks (or any confusingly similar mark) or related goodwill either during or after the Term. If Customer uses any AnyChart Mark in its packaging, marketing, promotional or advertising materials, Customer shall execute such documents as AnyChart may reasonably request from time to time to record or effectuate AnyChart’s ownership of the AnyChart Marks and related goodwill. Customer shall not register any AnyChart Mark, or any mark confusingly similar to any AnyChart Mark, in any jurisdiction.

Ownership By XxxXxxxx. Xxxxxxxx owns and shall continue to own all right, title, and interest in and to the Intellectual Property. Customer agrees that no implied licenses exist and that it shall not obtain any right in or to any portion of the Intellectual Property or any modifications. Hornbill reserves all rights not expressly granted hereunder. Customer agrees to comply with any copyright notice or trademark guidelines as provided by Hornbill from time-to-time. Customer agrees to reasonably assist Xxxxxxxx, in perfecting and enforcing Xxxxxxxx’s proprietary rights and Confidential Information.
Ownership By XxxXxxxx. No leased equipment provided to you by XxxxxXXX shall be deemed fixtures or part of your realty. Our ownership of such Equipment may be displayed by notice contained on it. You shall have no right to pledge, sell, mortgage, otherwise encumber, give away, remove, relocate, alter or tamper with Equipment at any time. Any reinstallation, return, or change in the location of the Equipment shall be performed by us at our service rates in effect at the time of such service. We reserve the right to make such filings as may be determined to be necessary by us at our sole discretion to evidence our ownership rights in the Equipment, and you agree to execute any and all documents as may be so determined to be necessary for us to make such fillings. You are responsible for preventing the loss or destruction of leased Equipment, and we recommend that your Equipment be covered by your homeowners, renters, or other insurance policy.
Ownership By XxxXxxxx. As between the Parties, Xxxxxxxx owns and will continue to own all right, title and interest in and to the Andretti Materials (and, to the extent applicable, Xxxxxx hereby assigns all right, title and interest in and to the same) and the applicable third parties will continue to own all right, title and interest in and to Andretti Third Party Materials. All use rights not expressly granted herein are reserved to Andretti or the applicable third party. Xxxxxxxx grants Xxxxxx the limited right to view, modify, collect and use Andretti Materials and Xxxxxxxx Third Party Materials, for the purpose of providing the Orquestra Technology and for Xxxxxx’x internal purposes, including improving Xxxxxx’x products and services and communications with Xxxxxxxx. The Andretti Materials and Xxxxxxxx Third Party Materials and all information which is provided to Xxxxxx by Xxxxxxxx under this Agreement is confidential and considered Confidential Information of Xxxxxxxx. Notwithstanding the foregoing, Xxxxxx may use anonymized or general information derived from such Andretti Materials and aggregate it with information from other customers (“Non-Identifiable Aggregated Data”) for Xxxxxx’x business purposes, including without limitation for analyzing customer needs and improving its services. Xxxxxx will own all right, title and interest in any such Non-Identifiable Aggregated Data.

  • SHOP XXXXXXX The Shop Xxxxxxx shall be a County employee as selected by the Union. A list of shop stewards will be kept current and sent by the Union to each department head and to Human Resources. Duties required by the Union of its stewards, except attendance at meetings with the County, supervisory personnel and aggrieved employees arising out of a grievance already initiated by an employee under Article 14 hereof, shall not interfere with their or other employees, regular work assignments as employees of the County. The shop xxxxxxx, or their designee, involved with a particular grievance must be identified at Step 1 of the grievance procedure and will be designated as the only bargaining unit employee who will be able to gather information pertaining to that particular grievance. The Union will make reasonable efforts to control the amount of investigative time spent between the shop xxxxxxx and the aggrieved employee. Meetings scheduled with management and other proper investigative procedures, and attendance at meetings specified in Steps 1 and 2 of the grievance procedure shall be considered hours worked for compensation purposes to the extent such meetings occur during the normal hours of work, and not otherwise. In order to use union leave for this purpose, Shop Stewards must notify the supervisor/department head of meetings and other commitments at the time these are scheduled. Attendance at meetings specified in Step 3 of the grievance procedure shall be considered hours worked during regularly scheduled business hours of the County for the xxxxxxx involved, witnesses and the grievant. The County shall not be liable for any overtime as a result of the meeting. Witnesses and the shop xxxxxxx involved shall be granted leave with pay to the extent their presence at the proceedings is required. If it is a discharge case the grievant shall not be paid except as provided in a remedy awarded.

  • Xxxxxxx Xxxx CareFirst BlueChoice’s Service Area is a clearly defined geographic area in which CareFirst BlueChoice has arranged for the provision of health care services to be generally available and readily accessible to Members. CareFirst BlueChoice will provide the Member with a specific description of the Service Area at the time of enrollment. The Service Area is as follows: the District of Columbia; the state of Maryland; in the Commonwealth of Virginia, the cities of Alexandria and Fairfax, Arlington County, the town of Vienna and the areas of Fairfax and Xxxxxx Xxxxxxxx Counties in Virginia lying east of Route 123. SAMPLE If a Member temporarily lives out of the Service Area (for example, if a Dependent goes to college in another state), the Member may be able to take advantage of the CareFirst BlueChoice Away From Home Program. This Program may allow a Member who resides out of the Service Area for an extended period of time to utilize the benefits of an affiliated Blue Cross and Blue Shield HMO. This Program is not coordination of benefits. A Member who takes advantage of the Away From Home Program will be subject to the rules, regulations and plan benefits of the affiliated Blue Cross and Blue Shield HMO. If the Member makes a permanent move, he/she does not have to wait until the Annual Open Enrollment Period to change plans.
