Packing and Packaging. Seller shall preserve, package, handle, and pack the Products so as to protect the Products from loss or damage, in conformance with good commercial practices, Powerwave’s specifications, government regulations and other applicable requirements. Seller shall be responsible for any Product damage caused by any failure to comply with packaging specifications. Seller shall provide a detailed packing list attached to each pallet or container enclosed in a weatherproof package marked “Packing Slip Inside.” The packing slip and other documentation shall bear the applicable PO number and shipping destination. Cartons or pallets shall be consistently labeled and facing the same direction. Seller shall be responsible for any loss or damage due to its failure to properly preserve, package, handle or pack the Products. Hazardous materials must be packed and labeled as required by the appropriate government and carrier regulations. Machined surfaces must be given special protection against rust, corrosion, or any physical damage. Where applicable, all sides of the package shall be stenciled, using waterproof ink, with the appropriate marks, in English, listed below: — FRAGILE — HANDLE WITH CARE — THIS END UP (Stencil and arrow pointing up.) If Buyer directs Seller to mark or label any Parts with a trade name, trademark, or logo owned or licensed by Powerwave, Seller shall apply the marking or labeling only on the quantity of Products and in the manner specified in Powerwave’s written instructions.
Packing and Packaging. Unless otherwise specified in writing, all packing and packaging must be done in accordance with good, economical, commercial practice, and must consist of suitable containers for optimum protection of goods during delivery, handling, and storage. Seller will label and package all goods which are known to have health, poison, fire, explosion, or other risks and hazards in accordance with all applicable state and federal packaging and labeling laws and regulations and goods will be accompanied by all required Material Safety Data Sheets.
Packing and Packaging. ANDON shall package all shipments hereunder in accordance with standard commercial practices for shipment of goods that are the same or substantially similar. Each shipment shall contain a packing list indicating the order number, shipping symbols, serial numbers, weights, measurements, and other means of identification as may be directed by ATCOR or reasonably necessary to facilitate due delivery.
Packing and Packaging. All deliverables under this agreement shall be preserved and packaged in accordance with the most economical and best commercial practices to assure delivery at the destination and to prevent deterioration and damage due to shipping, handling and storage hazards.
Packing and Packaging. 10.1 Unless otherwise specified, each Party shall pack product in such a manner as to be reasonably safe from damage or deterioration while in transit or storage under generally foreseeable circumstances.
10.2 HITACHI shall package the HITACHI Products in a suitable cover that is dimensionally similar and of a style, including paint color, consistent with other HITACHI products, with the exception of labeling. HITACHI and NANOGEN shall mutually agree on the industrial design of such a cover and any future changes to the cover that may be requested by either Party.
Packing and Packaging. To the extent possible, orders will be packaged in blocks of twenty-four (24) individual WBSMs or multiples thereof. All deliveries to WildBlue pursuant to this Agreement shall be packaged in a manner consistent with industry standards for cable modems and packed for safe delivery to their destinations without damage. Wholesale, single color packaging is included in the purchase price. Contractor shall submit a retail outside packaging design and cable options package (to include Ethernet and USB cables) ("RETAIL PACKAGE") to WildBlue for WildBlue's approval on or before ***. The price for the Retail Package will be negotiated between the two parties. The Retail Package shall be an option for WildBlue. If the Retail Package option is requested WildBlue may purchase WBSMs with both the standard packaging and Retail Packaging. Packaging type will be specified on Orders.
Packing and Packaging. Unless specified in the PO, Xxxxxx agrees to prepare and properly box or crate Goods for shipment so as to prevent damage in transit. Seller agrees to pack all articles in a manner and with materials necessary to prevent deterioration, corrosion or damage. Sheet metal Goods are to be individually wrapped or otherwise packed to avoid metal-to-metal surface contact. Hardware is to be individually identified and packaged in bags with no more than 100 units per bag. Pre-mixed and frozen sealants are to be shipped at minus 10 degrees or colder. RT Protective covers or plugs must be installed on ducts, lines, tubes, vents, and electrical connectors or connections for protection from contamination and physical or electrostatic discharge type damage.
Packing and Packaging. Occupant acknowledges that Occupant assumes full responsibility and liability for packing, loading, and securing Occupant’s property within the Container for all of Occupant’s intended uses, including over-the-road transportation. Occupant also acknowledges that Occupant assumes full responsibility and liability for removal, unloading or unpacking of the property from the Container. The Container shall be packed according to the instructions provided such that if anything breakable is properly secured and packed. Occupant acknowledges that the Container is tipped 10˚ when loaded or unloaded on or off the Operator’s truck. Occupant may not request that Operator or Operator’s agents assist in the packing, loading, securing, unloading or unpacking of the Container. If Occupant disregards these directives and requests that Operator or Operator’s agents provide Occupant with loading or unloading services, Occupant does so exclusively at his/her own risk, and agrees to defend, indemnify and hold harmless Operator against any loss, damage, liability, claim, expense or injury to property or persons that may result from such packing services. IF OCCUPANT HIRES AN EMPLOYEE OF OPERATOR TO PROVIDE OR ASSIST WITH PACKING, LOADING, UNLOADING, UNPACKING OR OTHER SIMILAR SERVICES ANCILLARY TO OCCUPANT’S RENTAL OF THE CONTAINER, THEN OCCUPANT HAS CREATED A “BORROWED SERVANT” ARRANGEMENT WHEREBY SUCH EMPLOYEE IS NOT ACTING AS AN AGENT, SERVANT, OR EMPLOYEE OF OPERATOR, BUT RATHER AS A BORROWED SERVANT OF OCCUPANT. OCCUPANT AGREES THAT IN SUCH CIRCUMSTANCES SUCH EMPLOYEE IS SUBJECT TO OCCUPANT’S SOLE DIRECTION AND CONTROL.

All other deliveries to WildBlue pursuant to this Agreement shall be packaged in a manner consistent with ViaSat and WildBlue Confidential 17 industry standards and packed for safe delivery to their destinations without damage. Wholesale, single color packaging is included in the purchase price. Subject to Contractor having a firm WBSM delivery schedule, Contractor shall submit a retail outside packaging design and cable options package (to include Ethernet and USB cables) ("RETAIL PACKAGE") to WildBlue for WildBlue's approval not more than 30 days after WildBlue's written request in conjunction with a firm delivery schedule for the Initial WBST Order. The obligation to submit a Retail Package is a one-time event. The price for the Retail Package will be negotiated between the Parties. The Retail Package shall be an option for WildBlue. If the Retail Package option is requested WildBlue may purchase WBSMs with both the standard packaging and Retail Packaging. Packaging type will be specified on Orders.

The equipments, devices and components required under this agreement shall be packaged and packed for domestic shipment in accordance with best commercial practice to ensure safe arrival at destination unless otherwise specified on the individual Job Order or in writing by the contracting officer.
