Parties to continue to perform. Prior to resolution of the Dispute, the parties must continue to perform their respective obligations under this deed including all pre-existing obligations the subject of the Dispute, except only to the extent that lack of resolution of the Dispute prevents such performance.

DICTIONARY Agency Confidential Information means all Information disclosed (including inadvertently) by the Principal, a Customer or any of their Representatives in connection with the Head Agreement deed or a Customer Contract, all Information disclosed by a third party which the Principal or a Customer is required to keep confidential and all Information created by the Supplier in the course of providing the Services or in respect of Intellectual Property Rights owned by the Principal or a Customer including: confidential information of the Principal, a Customer or a third party to whom the Principal or a Customer owes an obligation of confidentiality; information derived partly or wholly from the Information including without limitation any calculation, conclusion, summary and computer modelling; and trade secrets or information which is capable of protection at law or equity as confidential information, but excludes the Excluded Information. Business Days means a day other than a Saturday, Sunday, public holiday in Sydney or 24 or 31 December. Change is defined in clause 8 of the Head Agreement; Change of Control occurs, in respect of an entity when: a person who did not have Control of the entity at the Commencement Date acquires Control of the entity; or a person who did have Control of the entity at the Commencement Date ceases to have Control of the entity.
