Patent License. Subject to the terms and conditions of this Agreement, Illumina grants to Licensee a personal, perpetual (unless terminated as provided in this Agreement), non-exclusive, revocable (for Licensee’s breach), non-transferable, non-sublicensable, royalty-free patent license with respect to the Software, for Licensee’sinternal end-use purposes only, in the ordinary course of Licensee’s business to use the Software in executable object code form only, solely at the Licensee’s facility to, install and use the Software on a single computer or server (including in the cloud or node of a server) accessible only by Licensee (and not on any public network or server), where the single computer is owned, leased, or otherwise substantially controlled by Licensee, where the foregoing license solely applies to patent claims licensable by Illumina that claim or cover the use of the Software for decompression of genomic data and that are necessarily infringed by use of the Software.
