Common use of Pay Entitlement - Criminal Case Clause in Contracts

Pay Entitlement - Criminal Case. No employee shall be entitled to receive such pay where the employee is summoned to give evidence in any civil litigation to which the City is not a Party, or where the employee is summoned to give evidence in a criminal case, or when the employee is the person charged in any court, unless such criminal case arises out of actions by the employee in the course of their employment. This will not apply where the City and the employee are both charged and/or convicted under the Occupational Health and Safety Act.
